If I lose the first appeal, what does it cost to go to the GST Appellate Tribunal?
An appeal to the GST Appellate Tribunal requires payment of the admitted dues in full plus an additional pre-deposit of 10 percent of the disputed tax, over and above the 10 percent already paid at the first appeal stage. Following the Finance (No. 2) Act 2024 amendments effective 1 November 2024, this additional deposit was reduced from the earlier 20 percent, and is capped at Rs.20 crore each under CGST and SGST. An appeal to the appellate authority must be filed in Form APL-01 within three months from the date the order is communicated to you. The appellate authority can condone a delay of up to one further month if you show sufficient cause, but has no power to admit an appeal beyond that. The clock runs from communication of the order, which is usually the date it is served on the portal. Diarise the deadline the day you receive any adverse order, because gathering documents, computing the pre-deposit and drafting grounds takes time. Apart from the pre-deposit, is there any court fee for filing a GST first appeal?
No separate court fee or filing fee is charged for an appeal in Form APL-01; the only statutory outflow is the pre-deposit, being the admitted amount in full plus 10 percent of the disputed tax. The law also caps the pre-deposit: with effect from 1 November 2024, the ceiling for a first appeal is Rs.20 crore each under CGST and SGST, reduced from the earlier Rs.25 crore. Such estimates are usually far higher than the actual dues. The assessment is deemed withdrawn if you file the valid return within sixty days of the order, on payment of late fee and interest. An audit under Section 65 is far wider: officers examine your books of account, records and returns together, can visit your premises, and test classification, valuation, ITC eligibility and exemptions for the years covered by the ADT-01. No. The general reverse charge on all unregistered purchases under Section 9(4) was never fully implemented and now applies only to notified classes, principally real estate. A promoter must procure at least eighty percent of inputs and input services from registered suppliers for a project; on any shortfall, the promoter pays 18 percent under RCM, and cement purchased from an unregistered dealer attracts RCM at the rate applicable to cement, 18 percent since the September 2025 rate rationalisation reduced it from 28 percent, irrespective of the eighty percent test. Transfer of development rights and long-term leases to promoters are also covered. What is self-invoicing under RCM and is there a time limit for it?
