The applicant prepared food and served it in the canteens of client companies at their premises. It sought the rate applicable to this arrangement. The Authority held that the supply of food and beverages on the premises of an industrial undertaking was taxable at 18 percent up to 26 July 2018 and at 5 percent from 27 July 2018, when the restaurant service entry was amended to cover canteens at offices and factories, the concessional rate being available without input tax credit.

What to do about it: Chennai canteen contractors should bill factory and office canteens at 5 percent and forgo input tax credit on their purchases.

M/s. Prime Gold International Ltd v. Additional Director General — Madras High Court, W.P. No. 8203 of 2022, decided 2 August 2023 (C. Saravanan J.) · 2023-08-02

The petitioner challenged a provisional attachment of its bank account. By the time the matter was heard, one year had elapsed from the date of the order. The Court observed that orders of attachment under Section 83 are self-limiting and remain in force for one year only, after which nothing survives for adjudication. The writ petition was accordingly closed, the attachment having ceased to operate by force of the statute itself.

Up to three adjournments may be granted per side. The authority must pass a speaking order, which it should endeavour to issue within one year of filing, and the outcome is communicated in a summary along with the order. The authority can confirm, modify or annul the order but cannot send the case back to the original officer.
I discovered an old ASMT-13 order only after the return-filing window closed. What can I do now?
Once the sixty-day window and the further sixty-day extended window under Section 62 have both lapsed, filing the return no longer withdraws the order, and the estimated demand in the liability register becomes recoverable. Your remedy shifts to an appeal in Form APL-01 within three months of the order's communication, with the prescribed pre-deposit, arguing the actual figures from your books against the officer's estimate. Appellate authorities regularly scale down best judgment estimates when the genuine return data is placed on record. I paid a demand through DRC-03 but the portal still shows it outstanding. What is Form DRC-03A?
This happens because a DRC-03 payment does not automatically knock off a demand created in the electronic liability register through DRC-07. Form DRC-03A, introduced through Notification 12/2024 and Rule 142(2B), lets you link an earlier DRC-03 payment made under the cause voluntary or others to a specific demand order. File it under My Applications, select the DRC-03 ARN and the demand order number, and the system adjusts the liability register accordingly. What happened to the old 12 percent and 28 percent GST slabs?
Both slabs were abolished with effect from 22 September 2025. Nearly all goods that were at 12 percent moved down to 5 percent, and the bulk of the 28 percent items moved to 18 percent, with only a small set of luxury and demerit goods shifted up to the special 40 percent rate. This means old rate charts, printed price lists and software masters created before September 2025 are unreliable. Are any goods exempt from GST when transported by a GTA?
Yes. After logging in, open My Profile and select Register or Update DSC, choose the authorised signatory's PAN, and sign with the USB token; the certificate must be Class 3 and the PAN on it must match the signatory's PAN on the portal. Signing requires the emSigner utility running in the background, and the common failure to establish connection error means emSigner is not started, is blocked by the browser, or another application occupies its port. Run emSigner as administrator, keep the token connected, and use the trusted-site settings the portal recommends.
