The 55th GST Council recommended a single rate for the second-hand vehicle trade, and this notification raised the concessional rate on old and used motor vehicles, including electric vehicles, from twelve per cent to eighteen per cent. The tax continues to be charged only on the supplier's margin, and the levy still applies only where the seller is registered and is dealing in such vehicles; a sale by one individual to another remains outside GST altogether.
Why this matters: Used-car dealerships in Chennai charge eighteen per cent on the margin from 16 January 2025, while private person-to-person sales attract no GST.

Implementing 55th GST Council decisions, CBIC clarified that penal charges levied by banks and NBFCs for breach of loan terms, which replaced penal interest per RBI directions, are not consideration for any service and attract no GST. It also clarified that RBI-regulated payment aggregators are covered by the exemption for settlement of transactions up to Rs 2,000, and addressed other service-tax positions, regularising past periods on an as-is basis.
Why this matters: Borrowers should not accept GST charged on penal charges by lenders, and merchants using payment aggregators get relief on small-ticket settlement charges.
34th GST Council Meeting (video conferencing) — 19 March 2019 · 2019-03-19
The Council gave promoters a one-time option to continue paying tax at the old effective rates of eight or twelve per cent with input tax credit on ongoing projects, meaning buildings where both construction and actual booking had started before 1 April 2019 and which were not completed by 31 March 2019. The option had to be exercised once within a prescribed time frame, failing which the new rates applied automatically. Credit for projects moving across was to be transitioned pro rata.
What to do about it: Chennai builders who did not formally exercise the option in 2019 are on the one and five per cent no-credit rates, and any credit claimed since then is exposed to reversal.
