Circular No. 178/10/2022-GST · 2022-08-03
This is the leading circular on the agreeing to tolerate an act entry. The Board held that liquidated damages paid for breach of contract are a flow of money compensating for injury, not consideration for any service, so no GST applies. The same reasoning covers notice pay recovered from employees, cheque dishonour charges, fines and penalties for violation of a contract or a law, and forfeiture of salary or bond amounts, unless there is a genuine independent agreement to tolerate an act. A late payment surcharge or fee is treated differently, as it is naturally bundled with the principal supply and forms part of its value.

Tata Motors Ltd — AAR Gujarat, Advance Ruling No. GUJ/GAAR/R/39/2021, dated 30 July 2021 · 2021-07-30
The Gujarat AAR held that the nominal amount Tata Motors collects from employees for canteen food, which it passes on to the canteen contractor without any profit, is not consideration for a supply and does not attract GST. However, it also held that input tax credit on the GST charged by the canteen service provider is blocked credit under Section 17(5)(b)(i) of the CGST Act and cannot be claimed by the employer, even though the canteen is maintained to comply with the Factories Act, 1948.
Why this matters: Even where employee canteen recoveries escape GST, do not claim ITC on caterer invoices without checking the Section 17(5) blocked-credit conditions.
K.P. Mozika v. Oil and Natural Gas Corporation Ltd — Supreme Court, Civil Appeal No. 3548 of 2017, judgment dated 09-01-2024 · 2024-01-09
The Supreme Court examined contracts for supplying cranes, tankers and vehicles to ONGC. It held that a transfer of the right to use goods requires the customer to obtain effective control and legal right to use the goods to the exclusion of the owner. Where the owner retains the operator, control and responsibility, the arrangement is a service contract and not a deemed sale. Sales tax or VAT was therefore not attracted; service tax was.
Why this matters: Chennai transport, crane and equipment hire businesses should draft contracts carefully, since who controls the asset decides whether GST applies as a supply of service or of goods.
