The 41st meeting was convened with a single agenda item, GST compensation to states and union territories, after collections collapsed during the pandemic. The Centre placed before the Council two borrowing options for meeting the compensation shortfall for 2020-21: a special window facilitated by the Reserve Bank of India for the portion of the shortfall attributed to GST implementation itself, or market borrowing of the entire estimated shortfall by the states, in both cases serviced from future compensation cess collections. States were given a short period to convey their choice.

The Madras High Court upheld the condition in Section 16(2)(c) CGST Act that input tax credit is available only if the tax charged has actually been paid to the Government by the supplier. The Court reasoned that ITC is a concession subject to statutory conditions, and protecting the revenue justifies placing the consequence of supplier default on the recipient, who can pursue contractual remedies against the supplier — a counterpoint to more taxpayer-friendly rulings elsewhere.
What to do about it: Vet your suppliers' compliance rigorously — in Tamil Nadu, courts have upheld ITC denial for supplier non-payment, so build GSTR-2B monitoring and vendor indemnity clauses into your process.
Circular No. 225/19/2024-GST · 2024-07-11
Building on the earlier corporate guarantee circular, the Board clarified that the special valuation rule in Rule 28(2) applies to guarantees issued or renewed on or after 26 October 2023, and that the one per cent value is to be read as one per cent per annum of the guarantee amount, apportioned where the guarantee runs for a shorter period. It also confirmed that where the recipient is eligible for full input tax credit, the value declared in the invoice is deemed to be the open market value.
What to do about it: Chennai promoters and holding companies giving guarantees for group borrowings should compute the value annually and, where the borrower takes full credit, can adopt the invoice value.
