The Supreme Court held that a show cause notice must clearly specify the action or penalty proposed, so that the noticee can meet the case against him. An authority cannot impose a consequence that was never put to the party in the notice. Any order that goes beyond the scope of the notice is bad in law and liable to be set aside for breach of natural justice.

The penalty is Rs.10,000 or an amount equivalent to the tax evaded or credit wrongly taken, whichever is higher. For short payment of tax, Section 122(2) prescribes 10 percent of the tax or Rs.10,000, whichever is higher, in non-fraud cases, and a penalty equal to the tax or Rs.10,000, whichever is higher, where fraud is involved. An equal penalty applies under the SGST Act.
Can a person who never filed the returns still be penalised in a fake invoice case?
Yes. Section 122(1A) targets the person at whose instance fake transactions are conducted and who retains the benefit, even if the invoices were issued through some other entity. Where the offence involves supplying without an invoice, issuing invoices without supply, or availing or passing on credit from such invoices, the beneficiary faces a penalty equal to the tax evaded or the credit availed or passed on. This is how masterminds behind billing rackets are penalised alongside the front companies. Quite possibly, yes. Since 1 January 2019, security services meaning supply of security personnel, when provided by any person other than a body corporate to a registered person, fall under reverse charge, so the agency correctly bills without tax and you pay 18 percent through GSTR-3B in cash, claiming ITC. If your security agency is a private limited company, however, RCM does not apply and it must charge GST on its invoice under forward charge. What are OIDAR services under GST and who pays the tax on them?
OIDAR means Online Information Database Access or Retrieval services, delivered over the internet, such as cloud services, e-books, streaming, online advertising and automated e-learning. When a foreign OIDAR provider supplies these to unregistered persons in India, the foreign provider itself must take a simplified registration in Form REG-10 and file monthly return GSTR-5A. From 1 October 2023, the definition was widened, so almost every unregistered Indian recipient is covered. What is the GST treatment for an event management company handling corporate events?
Event management services attract 18 percent with full input tax credit. Place of supply rules deserve attention: for organising an event for a registered client, the place of supply is the client's location, so a Chennai company organising a Goa offsite for a Bengaluru-registered client charges IGST to Karnataka. For unregistered clients, the place of supply is where the event is actually held. Admission tickets are taxed where the event takes place. Getting the state wrong means the client's credit is jeopardised and the tax may need repayment under the correct head, so event companies serving multi-state clients should map each contract before invoicing.
Do I have to issue an invoice for every small cash sale in my shop?
Not necessarily. Where the value of a supply is less than Rs.200, the buyer is unregistered, and the buyer does not ask for an invoice, you may skip issuing an individual tax invoice. Instead, you must prepare one consolidated tax invoice at the close of each day covering all such small sales. The moment a customer demands an invoice, or the sale is Rs.200 or more, a proper invoice is required. Retail counters typically issue system receipts to every customer anyway, which is cleaner practice, but the daily consolidated invoice is the legal minimum for petty sales.
How many digits of the HSN code must I print on my tax invoices?
Under Notification 78/2020 Central Tax, taxpayers with aggregate turnover up to Rs.5 crore in the preceding financial year must mention a 4-digit HSN code on all B2B tax invoices, though it is optional on B2C invoices. Taxpayers with turnover above Rs.5 crore must mention 6-digit HSN codes on every invoice, including B2C. Eight digits are required for specified goods such as certain chemicals and for export documentation. Services follow the same rule using SAC codes, which begin with 99.
