A day before the change took effect, the Tax Research Unit issued FAQs explaining that the expression takes its meaning from the Legal Metrology Act, 2009 and covers commodities intended for retail sale in packs of up to twenty-five kilograms or twenty-five litres that must bear statutory declarations. A single package above that limit is not covered, nor are packs supplied to an industrial or institutional consumer. Loose sale from a large pack by a retailer does not attract the levy.
How we apply it: A fifty-kilogram rice bag sold as one package stays outside the levy, but the moment it is repacked into labelled retail bags of twenty-five kilograms or less, five per cent applies.

CBIC explained the scope of the phrase 'regularised on as is where is basis' used when the Council settles a disputed rate or classification. Where taxpayers paid at the lower of two competing rates or claimed an exemption in good faith, the past position is accepted as full discharge and no differential demand arises. However, no refund is available to anyone who paid at the higher rate or did not claim the exemption, and the circular works through illustrations showing exactly which past positions stand closed.
Practical effect: Read any rate clarification circular alongside its regularisation paragraph, because that paragraph often extinguishes the entire exposure for earlier years.

An SEZ unit had accumulated unutilised IGST credit distributed to it by its Input Service Distributor. The refund was rejected on the ground that Rule 89 permits only the supplier to SEZ to claim refund. The High Court allowed the refund of about Rs. 99 lakh, holding that where an ISD has already distributed the credit there is no supplier who can claim it, and that a circular cannot override Section 54 of the CGST Act to leave the credit permanently stranded.
What it means for you: If credit is genuinely stuck with no other route to recover it, a rigid reading of the refund rules or a circular is not a valid ground for rejection.
