Following widespread demands computing interest on the gross tax liability of a late GSTR-3B, ignoring the credit balance available, the Council recommended that interest under Section 50 be charged only on the net cash tax liability, with retrospective effect from 1 July 2017. This was given effect through the proviso to Section 50(1) inserted by the Finance Act, 2021 and notified retrospectively, and it neutralised thousands of interest demands raised on gross turnover across the country.

The late fee payable under Section 47 for GSTR-3B was waived entirely for the tax periods February, March and April 2020, subject to the return being furnished within the extended dates set out for each turnover slab. Large taxpayers had to file by 24 June 2020, while smaller taxpayers had staggered dates running into June and July 2020. If the return was filed after the specified date the waiver fell away and the ordinary late fee revived from the original due date.
What it means for you: Check the actual filing date before paying any late fee demand for February to April 2020, because a timely filed return under this notification carries no fee at all.

Exercising its powers under Article 142, the Supreme Court directed that the period from 15 March 2020 to 28 February 2022 shall stand excluded in computing limitation for any suit, appeal, application or proceeding, whether under general law or any special law. Where the balance limitation remaining was less than ninety days, a fresh period of ninety days from 1 March 2022 was granted. Statutory authorities were bound by this direction.
