GSTN Advisory dated 31 August 2023 — Electronic Credit Reversal and Re-claimed Statement · 2023-08-31
GSTN introduced the Electronic Credit Reversal and Re-claimed Statement on the portal to track credit reversed in Table 4B(2) of GSTR-3B and later reclaimed in Tables 4D(1) and 4A(5). It applied from the August 2023 return for monthly filers and from the July to September 2023 quarter for quarterly filers. The cumulative opening balance of reversals awaiting reclaim had to be reported by 30 November 2023, with up to three amendments allowed until 31 December 2023. The portal now warns when reclaimed credit exceeds the available balance.
Practical effect: Maintain a running register of credit reversed and reclaimed, because the portal flags excess reclaims and the data feeds departmental scrutiny.

For online services supplied to unregistered persons, including OIDAR services, online gaming and subscriptions, CBIC clarified that the supplier must record the recipient's State on the tax invoice, which is then deemed the address on record for determining place of supply under Section 12(2)(b). Failure to collect and record the State means incorrect place of supply, wrong apportionment of tax between States, and exposure to penal action under Section 122(3)(e).

The Supreme Court held that a tax is not per se a restriction on the freedom of trade and commerce guaranteed by Article 301 of the Constitution.
