GSTN Advisory, 2023 — e-invoice enablement status and self-enablement on einvoice.gst.gov.in · 2023
GSTN clarified that the enablement status shown on the e-invoice portal is only a system facility and does not decide whether a taxpayer is legally required to issue e-invoices. A taxpayer whose aggregate turnover crossed the prescribed limit in any financial year from 2017-18 onwards must issue e-invoices for business-to-business supplies and for exports, and where the portal does not already show the GSTIN as enabled, the taxpayer can self-enable on the portal. Notified exempt classes such as banks, insurers and passenger transport operators remain outside the requirement.
What to do about it: Test turnover for every year since 2017-18 against the e-invoice threshold and self-enable, because not being enabled on the portal is no defence in an audit.

To revive the residential real estate sector, the Council recommended an effective GST rate of five per cent without input tax credit on residential properties outside the affordable segment, and one per cent without input tax credit on affordable housing, with effect from 1 April 2019. The Council reasoned that buyers would get a fair price, that disputes about builders not passing on credit would become irrelevant, and that unutilised credit which used to become a project cost would be removed.
Practical effect: Flat buyers in Chennai pay one or five per cent on under-construction purchases, but the builder cannot claim input credit, so the tax is embedded in the price rather than shown as recoverable.
Clay Craft India Pvt Ltd — AAR Rajasthan, Advance Ruling No. RAJ/AAR/2019-20/33, dated 20 February 2020 · 2020-02-20
The Rajasthan AAR held that GST was payable under reverse charge on remuneration paid to directors, including directors who were also on the company's payroll, alarming companies across India. CBIC settled the position through Circular No. 140/10/2020-GST dated 10 June 2020: where a director's remuneration is booked as salary and TDS is deducted under Section 192 of the Income-tax Act, it is covered by Schedule III and is outside GST, while remuneration on which TDS is deducted under Section 194J is liable to GST under reverse charge in the company's hands.
What to do about it: Pay GST under reverse charge only on non-employee director fees, and keep payroll records proving employee-director salaries are outside GST.
