The Supreme Court dismissed the department's appeal and confirmed that where a holding company issues a corporate guarantee for its group companies without charging any consideration, no service tax is leviable. A taxable service requires consideration, and where none flows, the charge fails. Under GST the position has since been altered by a specific valuation rule for corporate guarantees between related persons, so the current position must be checked separately.

The circular also addressed the classification of fly ash bricks and blocks, by-products of milling of pulses and dal such as chilka and khanda, treated sewage water, and nicotine polacrilex gum.
Why this matters: Electric vehicle sellers should not be forced into eighteen per cent merely because the battery is billed or leased separately, and this circular is the answer to such a notice.

The company took cars on lease and extended them to its employees, recovering part of the lease cost through salary deduction. It argued that this was a transaction with employees in the course of employment and therefore outside GST. The Authority, and the Appellate Authority on appeal, held that GST applies to the car facility extended to employees to the extent the lease cost is recovered from them, since only a perquisite provided without recovery is covered by the employment entry in Schedule III.
