An advertising agency was charged value added tax on the entire consideration although service tax had already been paid on the design element. The Supreme Court held that payments of service tax and of value added tax are mutually exclusive, so in a composite contract the value attributable to the service component cannot also be subjected to sales tax, and the two levies must attach to distinct parts of the transaction. Double taxation of the same value is impermissible.

No. Under Section 23 of the CGST Act, a person engaged exclusively in supplying goods that are wholly exempt from tax is not liable to register, regardless of turnover. Yes, the constitution documents differ. A partnership firm submits the partnership deed, the firm's PAN, and PAN, Aadhaar and photographs of all partners, with one partner named as authorised signatory through an authorisation letter. A private limited company submits its Certificate of Incorporation, company PAN, board resolution appointing the authorised signatory, and PAN, Aadhaar and photographs of directors; the company must sign the application with a DSC. My company has taken a residential flat on rent. Why is our accountant paying GST on it?
Because of a reverse charge entry effective 18 July 2022: renting of a residential dwelling to a registered person attracts 18 percent GST payable by the tenant under reverse charge, even when the landlord is unregistered. Renting to unregistered individuals for residence remains fully exempt. There is a carve-out from 1 January 2023: a proprietor renting a dwelling in his personal capacity for use as his own residence, on his own account and not for the business, is exempt. Companies and firms renting flats, including for guest houses, must therefore pay RCM monthly through GSTR-3B. We correct many such missed entries during our compliance health checks.
Is there a late fee for filing GSTR-1 after the 11th?
Yes. Late fee for GSTR-1 is Rs.50 per day of delay, and Rs.20 per day where there are no outward supplies, subject to caps linked to your turnover. Although the portal historically collected GSTR-1 late fees through the next GSTR-3B, the liability arises the moment the due date passes. Delayed GSTR-1 also hurts your customers, because your invoices miss their GSTR-2B and their input tax credit gets deferred, which can strain business relationships. Filing by the 11th every month avoids both the cost and the friction.
How long does a GST amendment take to get approved?
Non-core amendments, covering bank accounts, authorised signatory details and the goods and services list, take effect immediately upon submission with no officer involvement. Core amendments, covering legal name, trade name, places of business and promoter changes, go to the jurisdictional officer, who normally acts within about fifteen working days. If the officer neither approves nor issues a notice within the prescribed period, the amendment is deemed approved and the certificate updates automatically. If a notice seeking clarification is issued, reply within seven working days to avoid rejection. Track everything with the ARN generated on submission of REG-14.
What is self-invoicing under RCM and is there a time limit for it?
When you receive supplies liable to reverse charge from an unregistered supplier, Section 31(3)(f) requires you, the recipient, to issue an invoice on yourself, because the supplier cannot issue a tax invoice. You must also issue a payment voucher when paying the supplier. From 1 November 2024, Rule 47A prescribes a firm deadline: the self-invoice must be issued within thirty days of receiving the supply. This document is not a formality; the time limit for claiming the RCM credit is reckoned from the self-invoice, and its absence can cost you the credit besides inviting penalty. Maintain a monthly self-invoice series covering rent, freight, legal fees and similar unregistered-supplier heads.
Are any goods exempt from GST when transported by a GTA?
Yes. Transport by a GTA of agricultural produce, milk, salt and foodgrains including flours and pulses, organic manure, newspapers and magazines registered with the Registrar of Newspapers, relief materials for victims of calamities, and defence or military equipment is exempt regardless of freight value. Note that the older exemptions for small consignments, Rs.1,500 for a full truckload and Rs.750 for a single consignee, were withdrawn with effect from 18 July 2022, so ordinary cargo enjoys no value-based relief now. Transporters serving agricultural markets should describe the produce accurately on the consignment note to support the exemption.
Where is the place of supply for services connected to a building or land?
Services directly relating to immovable property, including those of architects, interior decorators, engineers, surveyors, construction and works contract services, renting, and accommodation in hotels, are supplied where the property is located, under Section 12(3). The recipient's location and registration are irrelevant. So a Guindy architect designing a factory in Coimbatore charges CGST plus SGST of Tamil Nadu, but for a project in Kochi the place of supply is Kerala and IGST applies. For hotels, the state where the hotel stands is always the place of supply, which is why accommodation is invariably billed with that state's local taxes regardless of where the guest's business is registered.
My customer says he cannot claim ITC because of my late filing. Is that correct?
Yes, he is right. A buyer can claim input tax credit only for invoices appearing in his GSTR-2B, which is generated from suppliers' GSTR-1 and IFF filings. If you file GSTR-1 after the 11th, your invoices miss that month's GSTR-2B and your customer's credit gets pushed to the next month, straining his working capital.
