55th GST Council Meeting, Jaisalmer — 21 December 2024 · 2024-12-21

The 55th meeting reduced GST on fortified rice kernel (FRK) to 5 per cent regardless of end use, supporting public distribution fortification programmes. Gene therapy was fully exempted from GST, a major relief for patients of ultra-expensive treatments. Autoclaved aerated concrete (ACC) blocks containing more than 50 per cent fly ash content were classified under HS 6815 at 12 per cent. The Council also reduced the rate of compensation cess to 0.1 per cent on supplies to merchant exporters, bringing it on par with the concessional 0.1 per cent GST rate on such supplies.

The applicant made polypropylene and recycled plastic trays used by farmers to raise paddy and vegetable seedlings, and argued that they were agricultural implements. The Authority held that the trays are other articles of plastic under heading 3926 90 99 and are taxable at 9 percent central tax and 9 percent State tax. Use in agriculture does not by itself bring a product within the exempt agricultural implements entry, and the material and the tariff description prevail over the end use.

Practical effect: Chennai suppliers to the farm sector cannot assume exemption merely because the buyer uses the product in agriculture.

Following technical glitches on the GST portal in the second week of January 2025, CBIC extended the due date for GSTR-1 of December 2024 to 13 January 2025 and for the October-December 2024 quarter under QRMP to 15 January 2025. GSTR-3B due dates were correspondingly extended to 22 January 2025 for monthly filers and to 24 or 26 January 2025 for quarterly filers depending on their State.

Once the bank receives your payment, a seventeen-digit Challan Identification Number, the CIN, is generated, comprising the CPIN plus the bank code, and the amount credits your electronic cash ledger. If a challan expires unpaid, simply generate a fresh one; no consequence follows. Payment modes include net banking, UPI, cards, NEFT or RTGS, and over-the-counter deposit up to Rs.10,000 per challan per tax period.
How does a GTA opt for forward charge, and by when must it be done?
The option is exercised by filing the Annexure V declaration on the GST portal. For an existing GTA, the window for a financial year runs from 1 January to 31 March of the preceding financial year, so the choice for the coming year must be locked in by 31 March. A newly registered GTA must file the declaration within forty-five days of applying for registration or one month from the date of obtaining registration, whichever is later. Once exercised, the option continues for future years automatically unless the GTA files Annexure VI to revert to reverse charge. What is a B2C large invoice and what is the current threshold?
A B2C large invoice is an inter-state supply to an unregistered person exceeding the notified value threshold, which was reduced from Rs.2.5 lakh to Rs.1 lakh. How and when can I opt in or out of the QRMP scheme?
The option is exercised on the GST portal under Services, Returns, Opt-in for Quarterly Return.
