The Maharashtra AAR held that liquidated damages recovered by MAHAGENCO from contractors for delayed completion of works are consideration for tolerating an act under Schedule II entry 5(e) of the CGST Act, classifiable under heading 9997 and taxable at 18 per cent. The AAAR upheld this view. The ruling drove years of demands on contract penalties, until CBIC Circular No. 178/10/2022-GST dated 3 August 2022 substantially narrowed the taxability of such recoveries by clarifying that genuine compensation for breach is not payment for tolerating an act.

Meeting on the day GST was launched, the Council revisited the rate on fertilisers. Officers calculated the pre-GST incidence at about 9.75 per cent, placing fertilisers between the five and twelve per cent slabs. After almost every State supported relief for farmers, the Chairperson recorded a consensus and the Council agreed to tax fertilisers at five per cent instead of twelve, notwithstanding the inverted duty refund burden this would create for manufacturers whose inputs were taxed at eighteen per cent.

Practical effect: The Council reopened a rate it had already fixed only weeks earlier, and the cut created the inverted duty structure that fertiliser dealers still claim refunds under.

Circular

No repeat physical verification of the same vehicle without fresh evidence

Circular No. 49/23/2018-GST dated 21 June 2018 · 2018-06-21

This circular modified the detention procedure. The expression three working days in the earlier circular was replaced by three days, and the release wording in FORM GST MOV-05 was corrected. Most importantly it reiterated rule 138C(2): once physical verification of goods in transit has been carried out at one place, no further physical verification of the same conveyance may be done anywhere in India unless specific information relating to tax evasion is made available subsequently.

What it means for you: A truck already verified once should not be stopped and unloaded again on the same journey, and the earlier verification report is your defence.

What is compounding of offences under GST and how much does it cost?
Compounding under Section 138 lets an accused settle a criminal prosecution by paying a compounding amount, after which no further criminal proceedings are initiated and any pending prosecution abates. It is available either before or after the institution of prosecution, but only after the tax, interest and penalty involved have been paid. Following the Finance Act 2023, the compounding amount ranges between 25 percent and 100 percent of the tax involved, substantially lower than the earlier slabs. The application is made in Form CPD-01 to the Commissioner, who passes an order in CPD-02 within ninety days. Compounding buys certainty; it does not erase the civil demand.
What imprisonment terms does GST law prescribe, and which offences are non-bailable?
Section 132 links punishment to the amount involved: imprisonment up to five years with fine where the tax evaded or credit misused exceeds Rs.5 crore, up to three years where it exceeds Rs.2 crore, and up to one year for the Rs.1 crore to Rs.2 crore band, which after the Finance Act 2023 changes survives only for the offence of issuing invoices without supply. A repeat conviction can attract up to five years regardless of amount. Offences involving supply without invoice, invoices without supply, credit from such invoices, and collected-but-not-deposited tax are cognizable and non-bailable when the amount exceeds Rs.5 crore; everything else is non-cognizable and bailable. Courts take cognizance only with the Commissioner's previous sanction.
My GST registration was rejected in REG-05 after a clarification notice. Can I apply again?
Yes. A rejection order in Form REG-05 does not bar you from applying afresh. You can file a new registration application after curing the defects the officer pointed out, such as an incomplete rental agreement, mismatched address proof or missing authorisation letter. Alternatively, if you believe the rejection was wrong, you can challenge the order by filing an appeal in Form APL-01 within three months. I received a GSTR-3A notice for not filing my GST returns. What should I do?
GSTR-3A is a system-generated default notice issued under Section 46 when you fail to file a return such as GSTR-3B. You must file the pending return within fifteen days of the notice, along with the tax due, interest at 18 percent per annum and late fee of Rs.50 per day (Rs.20 per day for nil returns, both capped with reference to turnover). Once the return is filed within this window, no further action follows. If you have stopped business, apply for cancellation instead of leaving returns pending, because notices will keep coming every month.
The department has provisionally attached my bank account under Section 83. What does that mean?
Section 83 empowers the Commissioner, where he records an opinion that protecting revenue requires it, to provisionally attach property including bank accounts during the pendency of specified proceedings, such as assessment, inspection or demand cases. The attachment order is issued in Form DRC-22 and a copy goes to your bank, which freezes debits. Crucially, the attachment automatically ceases to have effect after one year from the order, and it can be lifted earlier through Form DRC-23 if the Commissioner is satisfied. Courts insist the power is draconian and must be exercised with genuine, recorded reasons, which is a strong ground of challenge in suitable cases.
How will I be informed of the GST audit findings?
On conclusion of the audit, the officer must inform you of the findings, your rights and obligations, and the reasons for the findings in Form ADT-02 within thirty days. Before that, most audit teams share draft observations and seek your response, which is your best window to knock out weak points with documents. If the audit detects unpaid tax or wrongly availed ITC, you can accept and pay through DRC-03, or contest, in which case the department initiates proceedings under Section 73 or Section 74. Treat the draft objection stage seriously; a strong rebuttal there often prevents a show cause notice altogether.
I received Form ADT-01 saying my business is selected for GST audit. What does it mean?
ADT-01 is the intimation that the department will conduct an audit of your records under Section 65. The notice must be issued at least fifteen working days before the audit begins and will specify the financial years covered and the documents required. The audit may happen at your place of business or at the department's office. It is a detailed examination of returns, books, ITC claims and classifications, not a routine visit. Use the fifteen-day window to reconcile your data and organise records rather than waiting for the officers to arrive. How many days do I get to reply to an ASMT-10 notice?
The reply in Form ASMT-11 must be filed within thirty days of being informed of the discrepancies, or within such further time as the officer permits. The GST rate on my product changed. Which rate applies to pending orders and invoices?
Section 14 of the CGST Act decides this by looking at three events: the date of supply, the date of invoice and the date of payment. What GST rate applies to cars and two-wheelers now?
Small cars, meaning petrol cars up to 1200cc and diesel cars up to 1500cc with length not exceeding 4 metres, attract 18 percent GST, down sharply from the earlier 28 percent plus cess. What is the place of supply for freight and courier charges on goods?
For transportation of goods, including by courier, Section 12(8) fixes the place of supply as the location of the recipient where the recipient is registered. Where the recipient is unregistered, it is the location where the goods are handed over for transportation. So a registered Guindy manufacturer paying a transporter for a Chennai-to-Delhi movement has Tamil Nadu as the place of supply, and the RCM liability is paid as CGST plus SGST if the transporter is also in Tamil Nadu. This rule matters chiefly for paying reverse charge on GTA freight under the correct heads, because paying IGST where CGST and SGST were due creates a refund-and-repay exercise later.
What GST rate applies to a goods transport agency: 5 percent or 18 percent?
Both exist, depending on the option exercised. The default position is 5 percent payable by the specified recipient under reverse charge, with no input tax credit to the GTA. Alternatively, a GTA may opt to pay tax itself under forward charge, either at 5 percent without input tax credit or at the higher rate with full credit, which was revised from 12 percent to 18 percent with effect from 22 September 2025. The with-credit option suits transporters with large spends on vehicles and tyres. Once the forward charge option is exercised for a year, it applies to all consignments of that year.
Is GST payable under reverse charge on payments made to our company directors?
It depends on the capacity in which the director is paid. CBIC Circular 140/10/2020 settles the position: remuneration to a whole-time or executive director who is an employee, paid as salary with TDS under Section 192, is outside GST entirely as an employer-employee transaction. In contrast, sitting fees, commission and professional charges paid to independent or non-executive directors, typically suffering TDS under Section 194J, are taxable and the company pays 18 percent under reverse charge, claiming ITC.
