It asked whether it needed registration and whether the rent was exempt because the tenant was the government. The Authority held that renting of commercial property by the Board to a government or a business entity is not an exempt supply, so GST was payable on the rent collected.

The taxpayer had reported credit under the wrong heads in GSTR-3B, showing IGST instead of CGST and SGST, although the total credit taken matched the tax actually borne on purchases. A demand was raised for wrongly availed credit. The Division Bench held that a clerical and revenue-neutral error in classifying credit between heads does not amount to wrong availment attracting demand and interest, and the demand raised only on that ground could not be sustained.

What to do about it: If a notice alleges excess credit only because the IGST and CGST/SGST columns were swapped, show that the total credit matches your purchase register — the error is correctable.

CBIC explained the relief notified through Notifications 30 to 36 of 2020-Central Tax after the first lockdown. It set out, return by return and class by class, the extended dates for GSTR-3B and GSTR-1, the conditional waiver of interest for the tax periods February to April 2020 with nil interest for the first fifteen days and nine per cent thereafter for larger taxpayers, the waiver of late fee, the relaxation of the rule 36(4) credit restriction, and the extension for composition taxpayers.

If the return is not filed within fifteen days, the officer can complete a best judgment assessment under Section 62 and pass an order in Form ASMT-13, estimating your liability from GSTR-1 data, e-way bills and bank information. The important exception is the offence of issuing invoices without any actual supply of goods or services, where the lower threshold continues, reflecting the government's focus on fake billing networks. Prosecution is in addition to, not instead of, the monetary penalties and demand proceedings.
How can I verify whether a GST notice I received is genuine or fake?
Every communication from a central GST officer must carry a Document Identification Number (DIN), which you can verify on the CBIC website. Notices issued through the GST portal carry a Reference Number that can be checked after logging in, and a genuine notice will also appear in your View Notices and Orders or View Additional Notices and Orders tab. As per CBIC instructions, a communication without a DIN is treated as invalid. Be cautious of demands received only on WhatsApp or email asking for payment to personal accounts. Can a person who never filed the returns still be penalised in a fake invoice case?
Yes. Section 122(1A) targets the person at whose instance fake transactions are conducted and who retains the benefit, even if the invoices were issued through some other entity. Where the offence involves supplying without an invoice, issuing invoices without supply, or availing or passing on credit from such invoices, the beneficiary faces a penalty equal to the tax evaded or the credit availed or passed on. What is the difference between GST return scrutiny and a departmental audit?

Does compensation cess still apply on any goods?
For most goods, no. With the rate restructuring of 22 September 2025, compensation cess was discontinued on items such as cars, and the demerit burden was merged into the single 40 percent rate. The cess continues only on pan masala and specified tobacco products during the transition period while past compensation cess loan obligations are being discharged. A practical point for traders: balances of unutilised compensation cess credit cannot be cross-utilised against CGST, SGST or IGST liability, so businesses holding old cess credit should evaluate their position rather than assuming it will set off future tax.
Why is my e-way bill generation blocked on the portal?
Under Rule 138E, the e-way bill facility is blocked when a taxpayer has not filed GSTR-3B (or CMP-08 for composition dealers) for two or more consecutive tax periods. Since an e-way bill is mandatory for moving goods worth more than Rs.50,000, blocking effectively halts dispatches. Where is the place of supply for services connected to a building or land?
Services directly relating to immovable property, including those of architects, interior decorators, engineers, surveyors, construction and works contract services, renting, and accommodation in hotels, are supplied where the property is located, under Section 12(3). Goods sent on approval must be invoiced within six months, failing which tax becomes payable.
How does GST work on lorry freight paid to a goods transport agency?
A goods transport agency, identified by its issue of a consignment note, is taxed in one of two ways. By default, specified recipients such as companies and registered persons pay 5 percent under reverse charge on the freight and can claim it as ITC.
