The Supreme Court held that the doctrine of mutuality survived the Forty-sixth Constitutional Amendment. Supplies of food, drink and services by an incorporated members' club to its own members are not a sale or a service to another person, so sales tax and service tax could not be levied. Note that GST law was later amended, with retrospective effect from 1 July 2017, to specifically tax supplies between a club or association and its members.

Practical effect: Chennai clubs, associations and resident welfare bodies cannot rely on mutuality under GST any longer, as the law was amended to override this ruling.

The Council replaced the declared tariff basis for hotel accommodation with actual transaction value and reset the slabs with effect from 1 October 2019: nil where the value is up to Rs 1,000 per day, 12 per cent between Rs 1,001 and Rs 7,500, and 18 per cent above Rs 7,500. Outdoor catering, other than in premises having daily tariff above Rs 7,500, was reduced from 18 per cent with input tax credit to 5 per cent without credit. This substantially reduced tax on mid-segment hotels and on marriage and event catering.

The correction depends on the direction of the error. If you charged a higher rate than applicable, the excess tax collected must still be paid to the government under Section 76, or you can issue credit notes to customers within the permitted time and adjust the tax. If you charged a lower rate, the shortfall is your liability: pay the differential tax with interest at 18 percent per annum through your returns or Form DRC-03, and issue debit notes to registered buyers so they can take the additional credit. Crucially, adjudication notices such as ASMT-10, DRC-01A and DRC-01 appear under a separate tab called View Additional Notices and Orders, which many taxpayers never open. Also verify that the email and mobile number on your registration are current, since the portal sends alerts there. It can extend to Rs.25,000 under the CGST Act, with a matching penalty under the SGST Act, so the practical exposure is up to Rs.50,000 per contravention. Officers invoke it for procedural lapses such as not displaying the registration certificate, minor documentation errors during transit, or failure to furnish information called for. Because the amount is discretionary, a reasoned reply showing the breach was technical and without revenue loss often brings the figure down substantially.
How will I be informed of the GST audit findings?
On conclusion of the audit, the officer must inform you of the findings, your rights and obligations, and the reasons for the findings in Form ADT-02 within thirty days. Before that, most audit teams share draft observations and seek your response, which is your best window to knock out weak points with documents. If the audit detects unpaid tax or wrongly availed ITC, you can accept and pay through DRC-03, or contest, in which case the department initiates proceedings under Section 73 or Section 74.
