Consignments were detained because the e-way bills accompanying them had expired. The Court directed immediate release on furnishing a bank guarantee and, importantly, directed the assessing officer to consider whether the lapse was a substantive violation or only a technical breach, having regard to Sections 122, 125 and 126 of the CGST Act. Adjudication was to be completed within four weeks, with amounts already remitted by the transporter adjusted against the final determination.
Practical effect: A Chennai consignor whose goods are held for a stale e-way bill can seek release against security while pressing that Section 126 requires leniency for minor procedural lapses.
Rule 88C, CGST Rules, 2017, inserted by Notification No. 26/2022-Central Tax · 2022-12-26
Rule 88C requires the portal to intimate a taxpayer in Form GST DRC-01B whenever the output tax liability declared in GSTR-1 for a period exceeds the liability paid through GSTR-3B beyond the prescribed limit. The taxpayer must either pay the shortfall with interest through Form DRC-03 or furnish an explanation in Part B of DRC-01B within seven days. The facility went live on the portal from mid-2023 and an unanswered intimation blocks the next GSTR-1.
What to do about it: Reconcile GSTR-1 against GSTR-3B every month, because a DRC-01B intimation left unanswered for seven days will freeze your next outward supplies return.
GSTN Advisory dated 23 August 2024 — Rule 10A bank account furnishing · 2024-08-23
GSTN advised that under Rule 10A of the CGST Rules, registered taxpayers must furnish valid bank account details within 30 days of registration or before filing GSTR-1 or IFF, whichever is earlier. From 1 September 2024 the portal blocks GSTR-1 and IFF filing for taxpayers whose bank account details are not available and validated on the portal. The measure targets fraudulent registrations created without genuine banking trails.
What it means for you: Newly registered businesses should add and validate their bank account on the portal immediately after registration to avoid a filing blockage.
