Summing up a long debate over five-band and six-band options, the Chairperson proposed and the Council accepted a structure with one exempt category covering food grains and similar essentials, a lower rate of five per cent for goods consumed by vulnerable sections, standard rates of 12 and 18 per cent, and a higher slab of 28 per cent. A committee of officers was directed to fit individual goods and services into those slabs. Proposals for a 40 per cent slab were rejected.

It held that the term goods covers all types of movable property, tangible or intangible, provided the item can be abstracted, transmitted, transferred, delivered, stored and possessed. Branded software satisfies that test and is goods, even though the intellectual content is intangible. Customised software developed for a single customer stands on a different footing.

GSTN Advisory, April 2024 — reset and re-filing of Form GSTR-3B for certain identified taxpayers · 2024-04
GSTN found that in a small number of cases credit or liability figures had been wrongly auto-populated into GSTR-3B. The affected returns were reset and made available for filing afresh. Only the taxpayers identified by the system saw the option on their dashboard and they were given a short window to verify the figures and file again. No general facility to revise a filed GSTR-3B was created.
Practical effect: A filed GSTR-3B still cannot be revised as a rule, so verify the auto-populated figures carefully before you submit the return.
