17th GST Council Meeting, New Delhi — 18 June 2017 (PIB Release ID 1493128) · 2017-06-18
Responding to trade concerns about return readiness, the Council decided that for the first two months of GST, tax would be payable on a simple summary return, Form GSTR-3B, filed by the 20th of the following month. Invoice-wise details in GSTR-1 for July 2017 were to be filed between 1 and 5 September and for August between 16 and 20 September, with GSTR-2 auto-populated thereafter. This is the origin of the summary return that has governed monthly GST compliance ever since.
Why this matters: GSTR-3B was designed as a two-month stopgap and is still the return every Chennai business files monthly, which is why its legal status has been litigated repeatedly.
Circular No. 76/50/2018-GST dated 31 December 2018 · 2018-12-31
This circular answered a set of unrelated questions. The most important is that the penalty under section 73(11) does not apply where self-assessed tax shown in the return is paid late; only interest under section 50 and, where warranted, general penalty under section 125 arise. It also dealt with the rate applicable to notes issued under section 142(2) and who is the owner of goods in transit. A corrigendum of 7 March 2019 clarified that tax collected at source under the Income-tax Act is not included in the taxable value.
What to do about it: If a demand adds a heavy penalty simply because GSTR-3B tax was paid late, this circular is the answer.
Notification No. 83/2020-Central Tax · 2020-11-10
From January 2021 the outward supply statement in Form GSTR-1 became due on the 11th day of the month following the tax period for monthly filers. For registered persons furnishing GSTR-1 quarterly under the new scheme, the statement became due on the 13th day of the month following the quarter. This replaced the earlier practice of notifying due dates a few months at a time and gave the return calendar a stable shape that has continued since.
What it means for you: The 11th and the 13th are the fixed GSTR-1 dates for a Chennai business, and missing them delays credit for every customer you supply.
