Under the GST (Compensation to States) Act, 2017 a separate cess was levied on a short list of demerit and luxury goods over and above GST. Coal carried a specific cess per tonne, aerated waters attracted twelve per cent, motor cars carried one to twenty-two per cent depending on engine capacity and length, and pan masala, cigarettes and chewing tobacco carried the heaviest rates. Cess credit could only be set off against cess, never against CGST, SGST or IGST.

Practical effect: Dealers who handled cars, coal or aerated drinks had to maintain a separate compensation cess ledger, and that ring-fenced credit remains a live issue in old assessments.

Amnesty capping late fee at Rs 500 or Rs 1,000 for pending GSTR-3B from July 2017 to April 2021

The Council announced an amnesty scheme reducing late fee on pending GSTR-3B returns for the tax periods from July 2017 to April 2021. For taxpayers with no tax liability in those periods the late fee was capped at Rs 500 per return, and for others at Rs 1,000 per return, in each case counting central and state tax together. The reduced late fee applied only where the returns were furnished between 1 June 2021 and 31 August 2021, a window later extended to 30 November 2021.

What to do about it: Taxpayers who cleared four years of pending returns in this window paid a fraction of the statutory late fee, which is why acting promptly in an amnesty window matters so much.

Can my company claim ITC on GST paid to a contractor building our new office?
Generally no. Section 17(5) blocks input tax credit on works contract services and on goods or services used for construction of immovable property on your own account, even when the building is used for business. The exception is plant and machinery, so credit on GST paid for installing machinery, equipment or apparatus fixed to earth remains available. The block does not apply within the construction chain itself: a sub-contractor's works contract service supplied to the main contractor is creditable for the main contractor, since it is used for an onward works contract supply. My workshop bills customers for spare parts and labour together. How should GST be charged?
The accepted practice, supported by CBIC's clarification on servicing, is that where the invoice separately shows the value of parts and the value of labour, each takes its own treatment: parts as a supply of goods and repair labour as a service at 18%. How does a GTA opt for forward charge, and by when must it be done?
The option is exercised by filing the Annexure V declaration on the GST portal. For an existing GTA, the window for a financial year runs from 1 January to 31 March of the preceding financial year, so the choice for the coming year must be locked in by 31 March. A newly registered GTA must file the declaration within forty-five days of applying for registration or one month from the date of obtaining registration, whichever is later. Once exercised, the option continues for future years automatically unless the GTA files Annexure VI to revert to reverse charge. A client paid me an advance. Do I raise an invoice or something else?
On receiving an advance, you issue a receipt voucher under Rule 50, not an invoice; the tax invoice follows when the service is actually supplied. GST is payable on advances received for services in the period of receipt, and the receipt voucher documents that liability. Advances for the supply of goods are not taxed at receipt for normal taxpayers under Notification 66/2017. If the rate is not determinable when the advance arrives, tax is paid at 18 percent, and if the nature of supply is not determinable, it is treated as inter-state.
