Following Notification No. 37/2017-Central Tax, this consolidated circular extended the Letter of Undertaking facility to every registered exporter of goods or services except a person prosecuted for a GST or earlier-law offence involving tax evasion above Rs 250 lakh. An LUT is valid for the financial year in which it is furnished. Exporters who are ineligible must give a bond with a bank guarantee of up to fifteen per cent of the bond amount. It replaced Circulars 2/2/2017, 4/4/2017 and 5/5/2017.

The Court examined whether canned or branded software sold on floppies and discs could be taxed as goods under sales tax law. It held that the term goods covers all types of movable property, tangible or intangible, provided the item can be abstracted, transmitted, transferred, delivered, stored and possessed. Branded software satisfies that test and is goods, even though the intellectual content is intangible. Customised software developed for a single customer stands on a different footing.
Practical effect: Chennai software and IT product businesses should classify off-the-shelf licences separately from bespoke development, since the goods or services character drives the rate, the place of supply and the e-invoice treatment.

GSTN removed the requirement to select a refund period in chronological order for certain refund categories, so a claim need not follow strict sequence, and moved those categories to invoice-based filing. For export of services with payment of tax, supplies to special economic zone units with payment of tax, and deemed export claims by the supplier, the applicant uploads the specific invoices in the relevant statement and those invoices are then locked against a repeat claim. All returns due up to the date of the claim must be filed.
What it means for you: Keep returns current and your export invoice register clean, since refunds are now claimed invoice by invoice and each invoice can be used only once.
