Following Removal of Difficulty Order No. 05/2019-Central Tax, CBIC clarified that a person whose registration was cancelled on or before 31 March 2019 for non-filing of returns could apply for revocation up to 22 July 2019. Where cancellation took effect from the order date, all returns up to that date had to be filed first. Where it was cancelled retrospectively, returns for the whole period from the effective date of cancellation had to be furnished within thirty days of the revocation order.
What to do about it: This was the first revocation amnesty and set the pattern of every later one, so a Chennai business with a dormant cancelled GSTIN should watch for such windows.
Union of India v. Bharti Airtel Ltd — Supreme Court, 2021 · 2021-10-28
Bharti Airtel sought to rectify its GSTR-3B for July-September 2017 to claim refund of about Rs 923 crore excess cash paid, blaming the non-operational GSTR-2A at the time. The Supreme Court set aside the Delhi High Court order permitting rectification, holding that returns can only be corrected in the period in which errors are noticed, as the law then stood, and that taxpayers must self-assess from their own books, not the portal.
What it means for you: File GSTR-3B accurately the first time — correct discovered errors in the current period per the prescribed mechanism rather than expecting retrospective revision of old returns.
Notification No. 28/2023-Central Tax · 2023-07-31
This notification appointed 1 October 2023 as the date for most GST amendments of the Finance Act 2023. The most consequential change bars taxpayers from filing GSTR-1, GSTR-3B, GSTR-9 and GSTR-8 after three years from their due date. The GST portal began actually blocking such time-barred returns from the July 2025 tax period, permanently freezing any unfiled compliance older than three years along with the credit flowing from it.
What it means for you: Any return more than three years past its due date can no longer be filed at all, so clear historic backlogs immediately rather than assuming they can be regularised later.
