A single package above that limit is not covered, nor are packs supplied to an industrial or institutional consumer. Loose sale from a large pack by a retailer does not attract the levy.

The Authority held that the supply of food and beverages on the premises of an industrial undertaking was taxable at 18 percent up to 26 July 2018 and at 5 percent from 27 July 2018, when the restaurant service entry was amended to cover canteens at offices and factories, the concessional rate being available without input tax credit.

States were given a short period to convey their choice.

I got a show cause notice in REG-17 threatening cancellation of my GST registration. What should I do?
Form REG-17 is issued when the officer proposes to cancel your registration, commonly for continuous non-filing of returns, non-existence at the declared premises or wrongful ITC availment. You must reply in Form REG-18 within seven working days and attend the hearing if one is fixed. If the reply satisfies the officer, proceedings are dropped in REG-20; otherwise cancellation is ordered in REG-19. If cancellation happens, you can seek revocation in Form REG-21 within ninety days after filing all pending returns and paying dues. Because cancelled registrations freeze e-way bills and invoicing, treat a REG-17 in Kilpauk as urgent.
The department has provisionally attached my bank account under Section 83. What does that mean?
Section 83 empowers the Commissioner, where he records an opinion that protecting revenue requires it, to provisionally attach property including bank accounts during the pendency of specified proceedings, such as assessment, inspection or demand cases. Section 122(1) lists twenty-one offences, including supplying without an invoice, issuing an invoice without supply, collecting tax but not depositing it beyond three months, failing to deduct or collect TDS or TCS, wrongly availing input tax credit and failing to register when liable. The penalty is Rs.10,000 or an amount equivalent to the tax evaded or credit wrongly taken, whichever is higher. For short payment of tax, Section 122(2) prescribes 10 percent of the tax or Rs.10,000, whichever is higher, in non-fraud cases, and a penalty equal to the tax or Rs.10,000, whichever is higher, where fraud is involved. An equal penalty applies under the SGST Act.
How often should I get a GST health check done for my business?
At minimum once a year, ideally between September and December, because that window still allows you to correct the previous financial year through the November return-amendment deadline and finalise a clean GSTR-9 by its 31 December due date. Businesses with turnover above Rs.5 crore, multiple registrations or heavy ITC should review quarterly, since e-invoice obligations and larger credit volumes raise the stakes. A health check is also wise before events such as applying for a large refund, receiving an ADT-01 audit intimation, or a business sale, when past compliance suddenly gets examined closely. Consistency matters more than frequency.
What is the difference between GST return scrutiny and a departmental audit?
Scrutiny under Section 61 is a desk review of your filed returns, where the officer points out specific discrepancies through ASMT-10 and you explain them in ASMT-11; it is limited to what the returns reveal. An audit under Section 65 is far wider: officers examine your books of account, records and returns together, can visit your premises, and test classification, valuation, ITC eligibility and exemptions for the years covered by the ADT-01. I received a DRC-01 notice for ITC mismatch between GSTR-3B and GSTR-2A. How do I defend it?
Start with a supplier-wise reconciliation identifying why each credit is missing from GSTR-2A, such as the supplier filing late, quoting a wrong GSTIN or reporting B2B supplies as B2C. For FY 2017-18 and 2018-19, CBIC Circular 183/15/2022 permits proving genuine credits through supplier certificates or CA certificates, which resolves many Kilpauk cases. Are hospital and clinic charges exempt from GST?
Healthcare services provided by a clinical establishment, an authorised medical practitioner or paramedics are exempt from GST. This covers diagnosis, treatment and care for illness, injury, deformity or pregnancy in any recognised system of medicine in India, and includes transportation of patients by ambulance, which is separately exempt for any provider. Consultation fees, surgery charges, nursing and diagnostic services within this definition carry no GST, which is why hospitals do not charge tax on treatment bills. The exemption attaches to the nature of the service, not the size of the hospital, so both a large corporate hospital and a single-doctor clinic are covered.
