CBIC clarified three recurring place-of-supply questions. For transportation of goods, including by mail or courier, where the supplier or the recipient is outside India, Section 13(9) of the IGST Act stood omitted from 1 October 2023, so the place of supply is now fixed by the default rule in Section 13(2), namely the location of the recipient. For advertising services supplied to a government body, the place of supply follows the location of the recipient under Section 12(2) rather than the location of the hoardings, with State-wise allocation where the contract provides for it. For co-location of servers in a data centre, the supply is a bundle of hosting services and not a letting of immovable property, so the recipient's location governs.

Besides mirroring the domestic exemptions, it carries entries that only arise in a cross-border context, such as services received from a provider located in a non-taxable territory by specified recipients, and certain services relating to transportation of goods to a place outside India. Courts have relied on its Entry 13, covering renting of residential dwellings for use as residence, when deciding hostel and long-stay accommodation disputes.
What to do about it: Chennai exporters and importers of services should check this notification before assuming an inter-State or cross-border service is taxable.
CBIC Instruction No. 03/2025-GST · 2025-04-17
Responding to widespread complaints about arbitrary queries, CBIC directed registration officers to seek only the documents listed in Form GST REG-01. For rented premises a valid rent agreement with the owner's ownership proof suffices; for owned premises any one ownership document is enough; no-objection certificates suffice for consent premises. Officers must not demand physical originals, question the applicant's residential address or business activity, or raise presumptive queries, and any query must be specific and approved by the Deputy or Assistant Commissioner.
What it means for you: If a registration query asks for documents outside the prescribed list, cite this instruction in your REG-04 reply and escalate to the jurisdictional Commissioner if it persists.
