Circular No. 177/09/2022-TRU · 2022-08-03

The Board answered a set of service classification and exemption questions arising from the 47th GST Council meeting. Most importantly for property transactions, it confirmed that the sale of land after levelling and after laying drainage, water and electricity lines remains a sale of land under Schedule III and is outside GST, while development services such as levelling and laying of drainage lines that the developer itself receives from contractors attract GST at the applicable rate. Several other exemption and rate questions on specified services were also settled.

To revive the residential real estate sector, the Council recommended an effective GST rate of five per cent without input tax credit on residential properties outside the affordable segment, and one per cent without input tax credit on affordable housing, with effect from 1 April 2019. The Council reasoned that buyers would get a fair price, that disputes about builders not passing on credit would become irrelevant, and that unutilised credit which used to become a project cost would be removed.

What it means for you: Flat buyers in Chennai pay one or five per cent on under-construction purchases, but the builder cannot claim input credit, so the tax is embedded in the price rather than shown as recoverable.

GSTR-3B is the summary return through which you actually pay tax, so missing it attracts a late fee of Rs.50 per day (Rs.20 for nil returns) plus interest at 18 percent per annum on tax paid late.
How should I raise invoices on foreign clients and report them in my returns?
You may invoice in foreign currency, but your GST records must state the value in rupees. An export invoice under LUT should carry the endorsement that the supply is meant for export under Letter of Undertaking without payment of integrated tax, along with your GSTIN, SAC code and the recipient's overseas address. In GSTR-1, these invoices go into Table 6A marked without payment of tax, and the turnover flows into GSTR-3B as zero-rated supplies. Match every invoice to a FIRC or bank credit. Is there a late fee if I delay the monthly PMT-06 payment under QRMP?

Confirm with the CNF code received, and the portal issues an ARN. A nil GSTR-1 is possible only when there are no outward supplies at all, including no credit notes, amendments or documents to report for that period. Why is there GST on an under-construction flat but not on a ready-to-move one?
Construction of an apartment intended for sale is a supply of service only when any part of the consideration is received before the completion certificate is issued or before first occupation. Such under-construction sales attract 1 percent for affordable residential apartments and 5 percent for other residential apartments, both without input tax credit to the builder. Once the completion certificate is issued, sale of the building is neither a supply of goods nor of services under Schedule III, so a ready-to-move flat carries no GST at all, only stamp duty and registration charges. Timing of booking therefore changes the buyer's cost materially.
What is the default place of supply rule for services within India?
Section 12(2) of the IGST Act sets the general rule for domestic services: if the recipient is registered, the place of supply is the recipient's location; if unregistered, it is the recipient's address on your records, and failing that, the supplier's own location.
