Three assessment orders dated 31 January 2022 for 2019-20, 2020-21 and 2021-22 raising demands of about Rs 9 crore in all were challenged. The Madras High Court quashed all three along with the consequential recovery notice, holding that the officer had issued only an intimation in Form DRC-01A and had not followed the mandatory show cause procedure under Section 74(1) of the TNGST Act. The officer was directed to reissue proper notices and complete the assessments afresh after giving the taxpayer an opportunity to file objections and a personal hearing.

What to do about it: A large demand raised without a properly framed Section 74 notice can be set aside outright, so check the notice trail before conceding anything.

Notification No. 13/2022-Central Tax · 2022-07-05

Acting under Section 168A, CBIC extended the time limit for issuing orders under Section 73 in respect of the financial year 2017-18 to 30 September 2023. It also directed that the period from 1 March 2020 to 28 February 2022 be excluded when computing the limitation for issuing a demand order for an erroneous refund, and when computing the two-year period for filing a refund application under Section 54 or Section 55. The exclusion applies automatically and does not require any application.

Services by such institutions to their students, and specified input services to schools such as transport, catering and security, are exempt. Can one invoice contain items taxed at different GST rates?
Yes, there is no requirement to issue separate invoices per rate.
