48th GST Council Meeting (video conferencing) — 17 December 2022 · 2022-12-17
The Council recommended decriminalising parts of the GST regime. The minimum threshold of tax for launching prosecution under Section 132 was raised from Rs 1 crore to Rs 2 crore, except for the offence of issuing invoices without any supply. The compounding amount was reduced from the range of 50 to 150 per cent of tax to 25 to 100 per cent. Three offences were decriminalised altogether: obstructing or preventing an officer in the discharge of duties, deliberate tampering with material evidence, and failure to supply information.
What to do about it: Ordinary compliance failures below Rs 2 crore of tax no longer expose a Chennai proprietor to criminal prosecution, though fake invoicing remains prosecutable at any value.
Notification No. 10/2025-Central Tax (Rate), dated 17 September 2025 · 2025-09-17
Superseding the 2017 exemption notification, this list re-notifies all nil-rated goods with effect from 22 September 2025 and widens it significantly. Ultra-high temperature milk became exempt, chena and paneer became exempt whether or not pre-packaged and labelled, and all Indian breads including roti, chapathi, paratha, parotta, khakhra and pizza bread were exempted by name. Pencils, crayons, sharpeners, slates, maps, globes and exercise books were also brought to nil.
What to do about it: Dairy shops and bakeries in Chennai now bill paneer and parotta at nil, but must remember that exempt turnover blocks the corresponding input tax credit.
TVH Lumbini Square Owners Association - AAR Tamil Nadu, Order No. 25/ARA/2019, dated 21 June 2019 · 2019-06-21
A residents welfare association collected monthly maintenance contributions from its members. The Authority held that where the contribution per member exceeds Rs. 7,500 a month, GST is payable on the entire contribution and not merely on the amount above Rs. 7,500. The Madras High Court subsequently held, in Greenwood Owners Association, that only the excess over Rs. 7,500 is taxable, and associations now follow that judicial position.
Why this matters: Chennai apartment associations should apply the High Court position carefully and keep member-wise workings ready for departmental scrutiny.
