Textile rate increase deferred on the eve of implementation; existing rates continue

46th GST Council Meeting, New Delhi — 31 December 2021 · 2021-12-31

The 46th meeting was convened on the last day of 2021 with essentially one outcome. The Council recommended deferring the decision to change the rates in textiles that had been recommended at the 45th meeting, so that the existing rates in the textile sector would continue beyond 1 January 2022. The reversal came after sustained representations from textile states and the trade that the increase from 5 to 12 per cent would raise costs for consumers and unorganised weavers. The footwear rate increase, however, went ahead as planned.

The department demanded interest on the entire tax shown in belated GSTR-3B returns, including the part discharged from input tax credit. The Madras High Court held that interest under Section 50 is compensatory, and can be levied only on the belated cash payment of tax, not on input tax credit that was lying with the department all along. The proviso inserted in Section 50(1) was treated as curative and applicable to earlier periods as well.

Yes. Since the amendment to Section 34 by the CGST (Amendment) Act, 2018, effective 1 February 2019, the law permits one or more credit notes to be issued against one or more tax invoices of a financial year. A distributor giving a season-end adjustment to a retailer can therefore issue one consolidated credit note covering dozens of invoices, rather than one note per bill. When reporting it in GSTR-1, the portal accepts credit notes without invoice-wise linking for this reason. Maintain a working annexed to the credit note listing the invoices covered, because in scrutiny the officer will ask you to establish the linkage and the arithmetic.

When can goods move on a delivery challan instead of a tax invoice?
Rule 55 permits movement on a delivery challan where the transportation is not itself a supply: sending inputs or capital goods for job work, taking goods to an exhibition or for approval where the sale is not yet certain, supplying liquid gas where the quantity is unknown at removal, and moving goods in semi-knocked-down form in multiple consignments, where the full invoice travels with the first lot. The challan is prepared in triplicate and an e-way bill is still required where value thresholds are crossed. Goods sent on approval must be invoiced within six months, failing which tax becomes payable.
What is the penalty for running a business without GST registration?
A taxable person who is liable to register but fails to do so faces a penalty of Rs.10,000 or the amount of tax evaded, whichever is higher, under Section 122 of the CGST Act. Beyond the penalty, the department can demand the tax for the entire unregistered period with interest at 18 percent per annum, and you cannot recover that tax from customers you billed without GST. Goods moved without registration and e-way bills, required for consignments above Rs.50,000, also risk detention. Is GST still charged on health insurance premiums?
Not on individual policies. With effect from 22 September 2025, premiums on all individual life insurance policies and individual health insurance policies, including family floater and senior citizen plans, are exempt from GST, along with their reinsurance. Earlier these attracted 18 percent, so the change directly reduces the premium outgo for households. Group policies taken by businesses for employees continue to be taxable, and the input tax credit position on such group covers still depends on whether the cover is statutorily obligatory. What are the rules for numbering GST invoices?
The invoice serial number must be consecutive, must not exceed sixteen characters, and may contain alphabets, numerals and the special characters hyphen and slash, in one or multiple series. Each number must be unique for a financial year, so most businesses restart their series every April with a year prefix such as 2026-27/001. What happened to the old 12 percent and 28 percent GST slabs?
Both slabs were abolished with effect from 22 September 2025. Construction of an apartment intended for sale is a supply of service only when any part of the consideration is received before the completion certificate is issued or before first occupation. Once the completion certificate is issued, sale of the building is neither a supply of goods nor of services under Schedule III, so a ready-to-move flat carries no GST at all, only stamp duty and registration charges.
