The 56th GST Council meeting approved the biggest structural reform since 2017, replacing the 5, 12, 18 and 28 per cent slabs with a two-rate structure — a 5 per cent merit rate and an 18 per cent standard rate — plus a 40 per cent de-merit rate for a narrow set of luxury and sin goods. The company repaired Volvo vehicles in India during the warranty period and recovered the cost from Volvo Sweden, which owned the warranty obligation. The Karnataka Appellate Authority for Advance Ruling held that the service is rendered to the foreign manufacturer and not to the Indian vehicle owner. Since the recipient is outside India and payment is received in convertible foreign exchange, the transaction qualifies as export of service and is zero-rated.
What to do about it: Where a foreign principal owns the warranty obligation and pays you for honouring it, the recovery can be defended as an export of service.

Many taxpayers had inadvertently filed a nil refund application for a period and category even though they had a genuine claim, and the portal then blocked any fresh claim for that period. CBIC allowed such applicants to file a fresh refund application for the same period and category, subject to two conditions: the earlier nil claim must have been filed for that period under that category, and no refund claim under that category must have been filed for any subsequent period.
