The Namakkal manufacturer made carbonated beverages containing fruit juice and sought classification under the fruit pulp or fruit juice based drinks entry taxed at 12 percent. The Authority held that once carbon dioxide is added the product is classifiable under heading 2202 10 as waters containing added carbon dioxide and flavouring, and not as fruit juice under heading 2009, so the higher rate applicable to that entry along with compensation cess applies. The Appellate Authority upheld that view.
Practical effect: Chennai beverage makers must check whether the drink is carbonated before applying the 12 percent fruit drink rate.

Exporters who imported inputs without paying integrated tax and compensation cess under the advance authorisation and export oriented unit exemption notifications were barred by Rule 96(10) from claiming refund of integrated tax paid on exports. The Board clarified that where such exporters subsequently paid the exempted tax and cess along with interest and had the bill of entry reassessed by the customs authorities, the exemption is treated as not having been availed and the refund already taken stands regularised.
What it means for you: Chennai exporters facing recovery of integrated tax refunds under Rule 96(10) can close the issue by paying the import duties with interest and getting the bill of entry reassessed.

The Delhi High Court held that the deposits did not bear the hallmark of voluntary self-ascertainment under Section 74(5), noted the department's non-compliance with CBIC instructions barring recovery during search, and directed refund of the amounts with interest at 6 percent. The ruling strengthens the line of authority against collection of tax during investigation without adjudication.
Practical effect: Never let officers pressure you into on-the-spot DRC-03 payments during a search — payments made under coercion can be recovered back with interest through the courts.
