The option is exercised on the common portal for each quarter within a specified window, and once exercised it continues for future periods until it is changed. Crossing Rs 5 crore during a year makes the person ineligible from the next quarter.

CBIC clarified that maintenance charged by a resident welfare association is exempt where it does not exceed Rs 7,500 per member per month, a limit raised from Rs 5,000 with effect from 25 January 2018. An association is liable to register only if its annual turnover exceeds Rs 20 lakh and its charges exceed Rs 7,500. Where the limit is crossed, tax is payable on the entire amount and not merely the excess. A member owning two flats gets the limit separately for each, and the association can claim input tax credit.

The Supreme Court held that where a developer enters into an agreement with a buyer before construction is completed, the construction carried out thereafter is executed for the buyer and constitutes a works contract liable to tax. Tax can be levied only on the value of goods incorporated after the agreement date, and the value of land must be excluded. This judgment underpins the current GST treatment of under-construction property sales.
