A landowner obtained approval to develop agricultural land into residential plots and proposed to sell the plots after laying roads, drainage, water lines and other common facilities required by the plan sanction. The Gujarat Authority for Advance Ruling held that the sale price includes the value of development works, so the transaction is a taxable supply of construction service and not a bare sale of land. CBIC later clarified that sale of land after levelling, laying drainage lines and similar works is still sale of land under Schedule III and outside GST.

What penalties does Section 122 of the CGST Act prescribe, and for which offences?

I have been charging the wrong GST rate on my invoices. How do I fix it?
The correction depends on the direction of the error. If you charged a higher rate than applicable, the excess tax collected must still be paid to the government under Section 76, or you can issue credit notes to customers within the permitted time and adjust the tax. If you charged a lower rate, the shortfall is your liability: pay the differential tax with interest at 18 percent per annum through your returns or Form DRC-03, and issue debit notes to registered buyers so they can take the additional credit. At what amount of tax evasion can GST prosecution be launched?

What is compounding of offences under GST and how much does it cost?
Compounding under Section 138 lets an accused settle a criminal prosecution by paying a compounding amount, after which no further criminal proceedings are initiated and any pending prosecution abates. It is available either before or after the institution of prosecution, but only after the tax, interest and penalty involved have been paid. Following the Finance Act 2023, the compounding amount ranges between 25 percent and 100 percent of the tax involved, substantially lower than the earlier slabs. The application is made in Form CPD-01 to the Commissioner, who passes an order in CPD-02 within ninety days. Compounding buys certainty; it does not erase the civil demand.
My GST registration was rejected in REG-05 after a clarification notice. Can I apply again?
Yes. A rejection order in Form REG-05 does not bar you from applying afresh. You can file a new registration application after curing the defects the officer pointed out, such as an incomplete rental agreement, mismatched address proof or missing authorisation letter. Alternatively, if you believe the rejection was wrong, you can challenge the order by filing an appeal in Form APL-01 within three months. What is the difference between DRC-01A and DRC-01 in GST?
DRC-01A is a pre-show-cause intimation. DRC-01, by contrast, is the summary of a formal show cause notice under Section 73 or Section 74, which starts adjudication and must be answered in Form DRC-06. The reply to a show cause notice summarised in DRC-01 is filed in Form DRC-06 on the GST portal. Pan masala and tobacco products continue under their earlier levy structure until the compensation cess obligations are discharged, after which they move to the 40 percent rate as notified. Does compensation cess still apply on any goods?
For most goods, no. With the rate restructuring of 22 September 2025, compensation cess was discontinued on items such as cars, and the demerit burden was merged into the single 40 percent rate. Two documents are required. First, a self-invoice: Section 31(3)(f) obliges you to issue an invoice on yourself for goods or services received from an unregistered supplier on which you pay tax under reverse charge, and under Rule 47A this self-invoice must be issued within thirty days of receiving the supply. Second, a payment voucher under Rule 52 at the time of making payment to the supplier. The self-invoice is the document on which you claim the input tax credit of the reverse charge tax paid. What is the GST rate on a works contract for a commercial building?
Under GST, a works contract relating to immovable property is treated wholly as a supply of services, and the standard rate is 18 percent on the contract value, with the contractor eligible for input tax credit on cement, steel and other inputs. This applies to construction, fabrication, erection, repair and renovation contracts for factories, offices and commercial buildings. The old VAT-plus-service-tax splitting of material and labour is gone; one rate applies to the whole consideration. Contractors should also note that free-issue materials supplied by the client can affect valuation, so contract drafting deserves attention before quoting.
Are any goods exempt from GST when transported by a GTA?
Yes. Transport by a GTA of agricultural produce, milk, salt and foodgrains including flours and pulses, organic manure, newspapers and magazines registered with the Registrar of Newspapers, relief materials for victims of calamities, and defence or military equipment is exempt regardless of freight value.
