The Supreme Court set aside the Gujarat High Court and upheld the validity of the pre-import condition attached to the IGST and compensation cess exemption on imports under advance authorisation. Exporters who did not satisfy the condition had to pay the IGST. However, the Court directed that a facility be provided to enable such exporters to claim input tax credit or refund of the IGST so paid, so that no genuine exporter suffers a permanent loss.
Why this matters: Chennai exporters using advance authorisations must comply strictly with scheme conditions and, where duty has been paid, follow up on credit or refund entitlement.

The 56th GST Council meeting approved the biggest structural reform since 2017, replacing the 5, 12, 18 and 28 per cent slabs with a two-rate structure — a 5 per cent merit rate and an 18 per cent standard rate — plus a 40 per cent de-merit rate for a narrow set of luxury and sin goods. Most items at 12 per cent moved to 5 per cent and most at 28 per cent moved to 18 per cent. The new rates took effect from 22 September 2025 and remain in force.
What to do about it: Every Chennai business had to re-map product rates, reprice stock and update billing software from 22 September 2025 — rate mistakes since then invite scrutiny notices.
Circular No. 188/20/2022-GST · 2022-12-27
Where an unregistered person has borne GST on a flat booking or a long term insurance policy that is later cancelled, and the supplier can no longer issue a credit note because the time limit under Section 34 has expired, the buyer may claim the refund directly. The circular prescribes obtaining a temporary registration on the common portal using PAN, and filing FORM GST RFD-01 under the prescribed category with the cancellation document and proof of payment, subject to the minimum refund threshold.
