Notification No. 35/2021-Central Tax · 2021-09-24
The Central Goods and Services Tax (Eighth Amendment) Rules, 2021 inserted Rule 10B, requiring a registered person to authenticate the Aadhaar number of the proprietor, partner, karta, managing director or authorised signatory in order to file an application for revocation of cancellation, to file a refund application, or to obtain a refund of integrated tax paid on exports. Rule 89 and Rule 96 were amended to require that the refund be credited to a bank account linked to the same permanent account number as the registration.
Practical effect: A Chennai exporter cannot get a rupee of refund until Aadhaar authentication is completed and the bank account is validated against the same PAN.
41st GST Council Meeting (video conferencing) — 27 August 2020 · 2020-08-27
The 41st meeting was convened with a single agenda item, GST compensation to states and union territories, after collections collapsed during the pandemic. The Centre placed before the Council two borrowing options for meeting the compensation shortfall for 2020-21: a special window facilitated by the Reserve Bank of India for the portion of the shortfall attributed to GST implementation itself, or market borrowing of the entire estimated shortfall by the states, in both cases serviced from future compensation cess collections. States were given a short period to convey their choice.
Why this matters: The borrowings arranged here are why compensation cess continued to be collected on cess goods long after the five-year compensation period ended in June 2022.
Circular No. 235/29/2024-GST, dated 11 October 2024 · 2024-10-11
Implementing the 54th GST Council decisions, CBIC clarified that extruded or expanded savoury or salted products other than un-fried snack pellets fall under tariff item 1905 90 30 and attract twelve per cent prospectively, while un-fried or uncooked snack pellets continue at five per cent. Roof-mounted package unit air conditioning machines for railway coaches were held classifiable under heading 8415 and not as railway parts, and the rate position on motor car seats was settled.
Practical effect: Namkeen and extruded snack manufacturers must apply the clarified rate prospectively and can rely on the circular's regularisation for earlier supplies.
