CBIC explained the scope of the phrase 'regularised on as is where is basis' used when the Council settles a disputed rate or classification. Entry 66 exempts services supplied by an educational institution to its students, faculty and staff, and services relating to admission to or conduct of examinations. It also exempts transportation of students, catering including any government-sponsored mid-day meal scheme, security, cleaning and housekeeping supplied to an institution, but only where that institution provides education up to higher secondary level. An educational institution is one whose output leads to a qualification recognised by law, so private coaching classes fall outside the exemption.

Why this matters: A Chennai coaching centre or competitive-exam institute is fully taxable, while a recognised school or college is exempt, and the two must never be treated alike.

A residents welfare association collected monthly maintenance contributions from its members. The Authority held that where the contribution per member exceeds Rs. 7,500 a month, GST is payable on the entire contribution and not merely on the amount above Rs. 7,500. The Madras High Court subsequently held, in Greenwood Owners Association, that only the excess over Rs. 7,500 is taxable, and associations now follow that judicial position.

A single price for naturally bundled components is a composite supply, taxed at the rate of the principal supply. For a coaching institute, coaching is the principal supply, so the entire lump sum, including printed materials and boarding provided as part of the package, attracts 18 percent. Printing separate invoices for books at nil rate out of a bundled fee is a known audit red flag and is routinely rejected. If the institute genuinely sells optional printed books to anyone at a separate price, those standalone sales can take the book's own treatment. Structure the fee schedule deliberately, not after the demand arrives.
I generate e-invoices. Do I still have to prepare GSTR-1 separately?
If your aggregate turnover exceeds Rs.5 crore, e-invoicing is mandatory and the invoice details reported to the Invoice Registration Portal auto-populate into your GSTR-1. However, auto-population is not a substitute for review. B2C sales, exports without IRN issues, credit notes, amendments and advances still need to be verified or added manually before submission. What is the due date for GSTR-3B in Tamil Nadu?
For monthly filers, GSTR-3B is due on the 20th of the following month. If you are registered in Tamil Nadu and have opted for the QRMP scheme, your quarterly GSTR-3B is due on the 22nd of the month following the quarter. GSTR-3B is the summary return through which you actually pay tax, so missing it attracts a late fee of Rs.50 per day (Rs.20 for nil returns) plus interest at 18 percent per annum on tax paid late.
How does an ISD actually distribute credit among branches?
Distribution follows Section 20 read with Rule 39. Credit attributable to a single branch goes only to that branch; credit for common services is distributed among operational branches in the ratio of their turnover in the preceding financial year. The ISD issues an ISD invoice to each recipient GSTIN and reports the distribution in GSTR-6 by the 13th of the following month, after which the credit appears in each branch's GSTR-2B. IGST credit is distributed as IGST, while CGST and SGST credit is distributed as IGST to branches in other states. Excess distribution is recoverable from the recipient with interest, so the turnover ratios must be computed carefully each year.
What is a debit note under GST and when do I issue one?
You issue a debit note when the taxable value or tax charged in the original invoice was less than what is actually payable, for example a price escalation clause kicking in or a rate charged short. Declaring the debit note in GSTR-1 increases your output liability, payable with interest where the shortfall relates to an earlier period. There is no outer time limit on issuing a debit note itself. For your buyer, the debit note is a credit document: following the amendment to Section 16(4), the buyer's time limit to claim ITC runs from the date of the debit note, not the original invoice.
My turnover is Rs.1.2 crore. Is GSTR-9 compulsory for me?
No. For taxpayers with aggregate turnover up to Rs.2 crore, filing GSTR-9 has been made optional through CBIC notifications, and this relaxation has been continued year on year. If you do not file by the due date, the return is deemed furnished. That said, many businesses in Koyambedu still choose to file voluntarily because the exercise reconciles the year's GSTR-1, GSTR-3B, books and GSTR-2B, and surfaces excess credit claims or unreported liability before the department finds them. For taxpayers registered in Tamil Nadu, which falls in the category of states with the earlier date, the quarterly GSTR-3B under QRMP is due on the 22nd of the month following the quarter. So the return for April to June is due by 22 July, and so on for each quarter. The quarterly GSTR-1 is due by the 13th of the same month. When can goods move on a delivery challan instead of a tax invoice?
Rule 55 permits movement on a delivery challan where the transportation is not itself a supply: sending inputs or capital goods for job work, taking goods to an exhibition or for approval where the sale is not yet certain, supplying liquid gas where the quantity is unknown at removal, and moving goods in semi-knocked-down form in multiple consignments, where the full invoice travels with the first lot. The challan is prepared in triplicate and an e-way bill is still required where value thresholds are crossed. Goods sent on approval must be invoiced within six months, failing which tax becomes payable.
Which educational services are actually exempt from GST?
The exemption is confined to an educational institution as defined, meaning one providing pre-school education, education up to higher secondary school or equivalent, education as part of a curriculum for obtaining a qualification recognised by Indian law, or an approved vocational education course. Services by such institutions to their students, and specified input services to schools such as transport, catering and security, are exempt. Everything outside this boundary is taxable: private tuition, test preparation, hobby classes, skill courses without recognised certification, and training by ed-tech companies. The recognition of the qualification under Indian law is the decisive test, not the subject taught.

Yes. Import of services, meaning services from a supplier located outside India received by a person in India for business, attracts IGST under reverse charge in the recipient's hands, payable in cash and claimable as ITC if eligible. Two nuances matter: services from a related foreign party, such as your parent company, are taxable even without consideration under Schedule I, and OIDAR services supplied to unregistered consumers are taxed in the foreign supplier's own hands, not under RCM.
