In an ex-works contract, title and risk pass at the supplier's factory gate when goods are handed over to the carrier arranged by the buyer, even though physical delivery to the buyer happens later. CBIC clarified that the condition of receipt of goods in Section 16(2)(b) is satisfied at that point through the deemed-receipt provision, so the buyer may claim input tax credit in that period, subject to actual receipt, use in business and the other conditions of Section 16.
Practical effect: Buyers on ex-works terms, common in the automobile supply chain, need not defer credit to the month of physical arrival at their premises.

The taxpayer relied on tax invoices, e-way bills and bank payments to support its input tax credit claim. The High Court dismissed the writ petition, holding that the burden of proving the genuineness of a transaction lies squarely on the person claiming credit. Payment through banking channels alone is not enough. The dealer must also establish actual movement and receipt of goods through details of the vehicle, freight paid, acknowledgement of delivery and other corroborative records.
Why this matters: Retain lorry receipts, weighbridge slips, gate entries and freight payment proof for major purchases — invoices and bank transfers alone will not carry the day.
Notification No. 55/2020-Central Tax · 2020-06-27
This notification amended the earlier Section 168A notification and moved the outer date for compliances falling due between 20 March 2020 and 30 August 2020 to 31 August 2020. In substance it gave a further two months to complete any action, order, notice, appeal or application whose limitation had been frozen since the start of the lockdown. Officers as well as taxpayers took the benefit, so departmental orders passed up to that date remain valid.
Why this matters: When computing whether an appeal or an assessment for 2020 is within time, the period up to 31 August 2020 must be excluded under this notification.
