The Supreme Court held that circulars issued by the Board are binding on the departmental authorities, who cannot take a stand contrary to them. The department cannot argue against the correctness of its own circular to the detriment of an assessee who has acted on it. Even if the circular takes a view different from a court decision, the department remains bound by it until it is withdrawn.

The extension was announced together with the extension of the revocation deadline so that the two reliefs could be used in sequence.

The jurisdictional CGST formation is to verify the exporter's existence, the genuineness of the input tax credit claimed and the details in a prescribed verification report, and to complete the exercise within fourteen working days, after which the report goes to the Chief Commissioner and the refund is released if the verification is favourable.
