29th GST Council Meeting, New Delhi — 4 August 2018 (Signed Minutes, Agenda Item 3) · 2018-08-04
The Council approved a scheme to incentivise digital payment under GST. Concessions were to be given on B2C transactions paid through RuPay debit card, UPI, BHIM, USSD or BHIM-Aadhaar, by way of an automated refund to the consumer's account of twenty per cent of the total GST paid, subject to a ceiling of Rs 100 per transaction shared equally between CGST and SGST. The purchaser would be informed by SMS. The scheme was to run on a pilot basis in Assam, Tamil Nadu and any other volunteering State.
Practical effect: Tamil Nadu was one of only two States selected for this pilot, though the scheme was never rolled out in practice.
Circular No. 176/08/2022-GST · 2022-07-06
The Board withdrew Circular No. 106/25/2019-GST dated 29 June 2019, which had prescribed a special refund mechanism for retail outlets in the departure area of international airports supplying indigenous goods to outgoing international passengers. The special procedure on which that mechanism rested was discontinued, so the separate refund route no longer operates. Such outlets must now follow the ordinary refund provisions instead of the withdrawn special procedure.
How we apply it: Duty free operators at Chennai airport should file under the normal export refund provisions, as the older special refund circular no longer exists.
Amit Cotton Industries v. Principal Commissioner of Customs — Gujarat High Court, 2019 · 2019-06-27
An exporter's IGST refund on exported goods was withheld because it had claimed duty drawback at the higher rate. In Special Civil Application No. 20126 of 2018, the Gujarat High Court held that the shipping bill itself is deemed a refund application under Rule 96, the circular relied on by the department could not override the rules, and the refund of IGST paid on exports cannot be denied on account of the drawback claim. The court directed payment of the withheld refund with interest, setting a widely followed precedent for exporters.
What to do about it: If your IGST export refunds are held up over drawback technicalities, this precedent — followed by the Madras High Court — supports recovery of the refund with interest.
