The Karnataka AAR examined which income streams of an individual count towards aggregate turnover for GST registration. It held that salary received as an executive, full-time director is outside the ambit of GST and not includable in aggregate turnover. In contrast, remuneration of a non-executive director is a taxable service, and such amounts, along with partner's salary from a firm, interest income and rental income — including residential rent that is itself exempt — must be counted when testing the registration threshold.
What it means for you: Individuals with mixed income should compute the GST registration threshold carefully, excluding employee salary but including non-executive director fees and rentals.

Schedule IV at 1.5 per cent central tax, that is three per cent combined, covers pearls, silver, gold, platinum, base metals clad with precious metal, articles of jewellery, goldsmiths' and silversmiths' wares, imitation jewellery and coin. Schedule V at 0.125 per cent, that is 0.25 per cent combined, covers rough or simply sawn diamonds and unworked precious and semi-precious stones. A five-judge Bench overruled the earlier view and held that a composite contract for manufacture, supply and installation of a lift is a works contract, because the lift comes into existence as a functional unit only on installation at site. The dominant nature test was rejected for contracts falling within the deemed sale of works contracts. The composite character of such contracts is now the basis of works contract taxation under GST.
What to do about it: Chennai contractors doing supply-plus-installation work should classify the transaction as a works contract service under GST rather than splitting it into goods and labour.
