All returns due up to the date of the claim must be filed.

The appellate authority had rejected refund claims for August and September 2017 on the basis of a departmental circular. The Madras High Court set aside that rejection, holding that Section 54(3) of the GST Act permits an exporter to opt either for duty drawback or for refund of accumulated input tax credit, and that a circular cannot override the statutory provision.
