GSTN Advisory dated 23 August 2024 — introduction of the RCM Liability/ITC Statement · 2024-08-23
GSTN introduced a new RCM Liability and ITC Statement on the portal so that reverse charge tax declared in Table 3.1(d) of GSTR-3B can be matched against the corresponding credit claimed in Table 4A(2) and 4A(3). It applies from the August 2024 tax period for monthly filers and from the July to September 2024 quarter for taxpayers under the quarterly scheme. Taxpayers were required to report an opening balance of reverse charge liability paid but credit not yet claimed, or credit claimed without payment, within the window announced by GSTN.
Practical effect: Reconcile reverse charge payments with the credit taken every month, since the department can now see an RCM ledger for your GSTIN.
Notification No. 8/2018-Central Tax (Rate), dated 25 January 2018 · 2018-01-25
This notification gave second-hand vehicle dealers a concessional rate charged not on the sale price but on the margin, that is the difference between the selling price and the purchase price, or the depreciated value where depreciation was claimed under the Income-tax Act. The concession applied only if the supplier had not availed input tax credit on the vehicle, and where the margin is negative no GST is payable. Compensation cess on such vehicles was separately exempted.
Practical effect: A used-car dealer in Chennai pays GST only on the mark-up, so accurate purchase and sale records for each vehicle are the whole defence in an audit.
Circular No. 89/08/2019-GST dated 18 February 2019 · 2019-02-18
CBIC noticed that many taxpayers were not reporting details of inter-State supplies made to unregistered persons, composition dealers and UIN holders in Table 3.2 of FORM GSTR-3B, and in Table 7B of FORM GSTR-1 for invoices up to Rs 2.5 lakh. Because these figures drive the settlement of integrated tax between the Centre and the States, the circular directed that the information be furnished correctly and warned that failure attracts general penalty under section 125.
Why this matters: Businesses selling across State borders to consumers should keep Table 3.2 populated, since mismatches here are a common trigger for scrutiny notices.
