The purchaser would be informed by SMS. The scheme was to run on a pilot basis in Assam, Tamil Nadu and any other volunteering State.

Practical effect: Tamil Nadu was one of only two States selected for this pilot, though the scheme was never rolled out in practice.

This circular settled four recurring questions. Perquisites provided by an employer to an employee under a contractual employment agreement are not liable to GST. The proviso to Section 17(5)(b) applies to the whole of that clause, so credit is available where a supply is obligatory under any law in force. The electronic credit ledger may be used to pay output tax, including tax demanded under Sections 73 and 74, but never for reverse charge liability, interest, penalty or fees.

The Supreme Court laid down the "clean slate" principle. Once a resolution plan is approved by the adjudicating authority under the Insolvency and Bankruptcy Code, all claims not forming part of that plan stand extinguished. This expressly covers dues of the Central Government, State Governments and local authorities, including indirect tax dues. No creditor can afterwards initiate proceedings for a claim that was not lodged and dealt with in the plan.

I got a show cause notice in REG-17 threatening cancellation of my GST registration. What should I do?

Following the Finance Act 2023, the compounding amount ranges between 25 percent and 100 percent of the tax involved, substantially lower than the earlier slabs. The application is made in Form CPD-01 to the Commissioner, who passes an order in CPD-02 within ninety days. Compounding buys certainty; it does not erase the civil demand.
How will I know my scrutiny reply has been accepted by the GST officer?
If your explanation in ASMT-11 is found acceptable, the officer issues Form ASMT-12 informing you that the discrepancies stand explained and no further action is required on those points. The order appears in your Additional Notices and Orders tab on the portal. Keep the ASMT-12 safely with your reconciliation working papers, because the same period can still come up in a later audit and the closure order is your best shield. My customer says he cannot claim ITC because of my late filing. Is that correct?
Yes, he is right. A buyer can claim input tax credit only for invoices appearing in his GSTR-2B, which is generated from suppliers' GSTR-1 and IFF filings. If you file GSTR-1 after the 11th, your invoices miss that month's GSTR-2B and your customer's credit gets pushed to the next month, straining his working capital. Repeated delays lead buyers to withhold the GST portion of payments or move to more compliant vendors. Timely GSTR-1 filing is therefore a commercial necessity, not just a legal one. Should I claim a refund of my accumulated ITC or just carry it forward?

How do I document free samples and gifts given to customers?
Goods supplied genuinely free of cost to unrelated persons are not a supply, so no tax invoice is raised and no GST is charged; the movement is covered by a delivery challan marked as free samples. The cost is that input tax credit on those goods must be reversed. Two traps deserve care: gifts to related persons or between distinct GSTINs of the same PAN are taxable under Schedule I even without consideration, and promotional schemes like buy one get one are treated as a single price for two items, taxed normally with credit intact. There is no separate penalty provision for this lapse, so officers invoke the general penalty under Section 125, which can extend to Rs.25,000 under CGST with a matching state penalty.
