This substantially reduced tax on mid-segment hotels and on marriage and event catering.

Achampet Solar Pvt Ltd — AAAR Telangana, Order No. AAAR.COM/04/2022, dated 19 October 2022 (setting aside AAR Order No. 07/2022, dated 16 February 2022) · 2022-10-19

The Telangana AAR had held that liquidated damages recoverable by Achampet Solar from its contractor for delay in commissioning its solar plant were a taxable supply attracting 18 per cent GST. The Appellate Authority set that ruling aside on 19 October 2022, holding that such damages are compensation for breach of contract and not consideration for tolerating an act, so they do not qualify as a supply. The decision aligns with CBIC Circular No. 178/10/2022-GST dated 3 August 2022 on contractual damages.

Solar and other renewable energy projects are usually supplied as a single turnkey contract covering panels, structures, cabling, erection and commissioning, which led to endless disputes on whether the concessional goods rate or the higher works contract rate applied. From 1 January 2019 the law deemed seventy per cent of the gross consideration to be the value of goods, taxed at the concessional renewable energy rate, and thirty per cent to be the value of the taxable service. The same deeming continues in the current goods rate notification.

Where the offence involves supplying without an invoice, issuing invoices without supply, or availing or passing on credit from such invoices, the beneficiary faces a penalty equal to the tax evaded or the credit availed or passed on. Under GST, a works contract relating to immovable property is treated wholly as a supply of services, and the standard rate is 18 percent on the contract value, with the contractor eligible for input tax credit on cement, steel and other inputs. This applies to construction, fabrication, erection, repair and renovation contracts for factories, offices and commercial buildings. The old VAT-plus-service-tax splitting of material and labour is gone; one rate applies to the whole consideration. Contractors should also note that free-issue materials supplied by the client can affect valuation, so contract drafting deserves attention before quoting.
When can goods move on a delivery challan instead of a tax invoice?
Rule 55 permits movement on a delivery challan where the transportation is not itself a supply: sending inputs or capital goods for job work, taking goods to an exhibition or for approval where the sale is not yet certain, supplying liquid gas where the quantity is unknown at removal, and moving goods in semi-knocked-down form in multiple consignments, where the full invoice travels with the first lot. Are hospital and clinic charges exempt from GST?
Healthcare services provided by a clinical establishment, an authorised medical practitioner or paramedics are exempt from GST. This covers diagnosis, treatment and care for illness, injury, deformity or pregnancy in any recognised system of medicine in India, and includes transportation of patients by ambulance, which is separately exempt for any provider. Consultation fees, surgery charges, nursing and diagnostic services within this definition carry no GST, which is why hospitals do not charge tax on treatment bills. The exemption attaches to the nature of the service, not the size of the hospital, so both a large corporate hospital and a single-doctor clinic are covered.
My customer in Mumbai asked me to deliver goods directly to his buyer in Madipakkam. How do I bill this?
This is a bill-to ship-to transaction under Section 10(1)(b). When goods are delivered to a third party on the instruction of your customer, the law deems your customer's principal place of business as the place of supply, not the actual delivery point.
