The fifth condition in the definition of export of services requires that the supplier and recipient are not merely establishments of a distinct person. CBIC clarified that a company incorporated in India and a company incorporated abroad are separate legal persons, so an Indian subsidiary, holding company or group company supplying services to its foreign affiliate is not caught by that condition. Such supplies qualify as export of services provided the other four conditions are satisfied.
Practical effect: Chennai captive units and subsidiaries billing their overseas parent can claim zero-rating, which removed a major ground on which refunds were being rejected.
54th GST Council Meeting, New Delhi — 9 September 2024 · 2024-09-09
The Council reduced GST on three cancer drugs — Trastuzumab Deruxtecan, Osimertinib and Durvalumab — from 12 per cent to 5 per cent. Extruded or expanded savoury snacks and namkeens were cut from 18 per cent to 12 per cent prospectively, aligning them with similar ready-to-eat namkeens, while un-fried snack pellets stayed at 5 per cent. The Council also brought roof-mounted package unit (RMPU) air conditioning machines for railways under 28 per cent and moved car seats from 18 per cent to 28 per cent.
Practical effect: Snack manufacturers and distributors in Chennai should apply 12 per cent prospectively from the notification date, keeping evidence of the cut-off for past-period disputes.
Tamil Nadu Water Investment Company Ltd - AAR Tamil Nadu, advance ruling reported at 2019 (2) TMI 187 · 2019
The Chennai company provided management consultancy and detailed project report services to the Chennai Metro Water Supply and Sewerage Board for water related projects. It asked whether the service attracted GST. The Authority held that the supply was a pure service with no supply of goods involved, rendered in relation to a function entrusted to a municipality, and was therefore exempt from GST under the entry covering pure services supplied to government and local authorities.
