A printing house printed leaflets and similar material using content supplied by the customer but paper, ink and other physical inputs of its own. It asked for the correct classification and rate. The Authority held that this is a composite supply in which the printing service is the principal supply, and the supply is therefore taxable at 18 percent. The customer supplying only the content or artwork did not alter the classification.

Practical effect: A Chennai printer supplying its own paper should charge 18 percent on job printed leaflets instead of assuming a lower book rate.

M/s. Maheswari Enterprises v. State Tax Officer — Madras High Court (Madurai Bench), W.P.(MD) Nos. 6245, 6247 and 6249 of 2021, decided 19 July 2021 (Nisha Banu J.) · 2021-07-19

Assessment orders were passed without hearing the taxpayer, the department arguing that no hearing had been requested. The Madras High Court set aside the orders and remanded the matters, holding that under Section 75(4) of the TNGST Act a personal hearing has to be given whenever the authority proposes to pass an adverse order, irrespective of whether the taxpayer specifically asked for one. A reasonable opportunity of hearing was directed to be given within three months.

GST on molasses was slashed from 28 per cent to 5 per cent to benefit sugarcane farmers and reduce cattle feed costs. The Council also clarified that job work services of converting barley into malt attract the concessional 5 per cent rate applicable to job work in relation to food products, and not 18 per cent.

In practice, offering less disruptive security, demonstrating that the attachment cripples salaries and statutory payments, or showing that the underlying proceedings do not fall within Section 83 are effective grounds. Once the return is filed within this window, no further action follows. Can a GST officer arrest a businessman, and what safeguards exist?
Yes, but only within defined limits. Under Section 69, the Commissioner must record reasons to believe that a person has committed one of the serious specified offences, chiefly fake invoicing and evasion beyond the prosecution thresholds, before authorising arrest. For cognizable, non-bailable cases, the person must be produced before a Magistrate within twenty-four hours; for bailable offences, the Deputy or Assistant Commissioner can grant bail. Departmental instructions require that arrest is not routine and must be justified by factors like flight risk or evidence tampering.
