It also clarified, following Section 150 of the Finance (No. 2) Act, 2024, that no refund arises for tax already paid or credit already reversed on this issue.

What to do about it: The 16(4) relief works only prospectively against pending or unpaid demands; amounts already paid or reversed cannot be recovered as refunds, so prioritise open cases.

WABCO India Ltd - AAR Tamil Nadu, Order No. TN/10/AAR/2018, dated 27 September 2018 · 2018-09-27

The manufacturer supplied electrical wiring harness, essentially electrical wire with connectors at both ends, used in motor vehicles, and asked whether it should be classified as a motor vehicle part or as insulated electrical conductors. The Authority classified the product under heading 8544, which covers insulated wire and cable fitted with connectors, taxable at 9 percent central tax and 9 percent State tax following Notification No. 41/2017-Central Tax (Rate) dated 14 November 2017, the earlier rate having been higher.

Practical effect: Chennai auto component makers should classify by the tariff description of the article itself, not by the vehicle it eventually goes into.

The 41st meeting was convened with a single agenda item, GST compensation to states and union territories, after collections collapsed during the pandemic. The Centre placed before the Council two borrowing options for meeting the compensation shortfall for 2020-21: a special window facilitated by the Reserve Bank of India for the portion of the shortfall attributed to GST implementation itself, or market borrowing of the entire estimated shortfall by the states, in both cases serviced from future compensation cess collections. States were given a short period to convey their choice.

Is everyone facing GST prosecution eligible to apply for compounding?
No. The statute excludes several categories. A person who has already been allowed to compound once in respect of the specified serious offences cannot compound again. Persons accused of issuing invoices without any supply of goods or services, the classic fake billing offence, were excluded from compounding altogether by the Finance Act 2023, and anyone convicted by a court under the GST law is also barred. Notably, the same 2023 amendments removed the earlier bar on compounding where the conduct was also an offence under another law, so that ground no longer disqualifies an applicant. Eligibility should be assessed before paying the underlying dues, since payment is a precondition but not a guarantee of compounding.
What is the general penalty under Section 125 and when is it imposed?
Section 125 is the residual penalty provision for contraventions of the Act or rules for which no separate penalty is prescribed anywhere else. It can extend to Rs.25,000 under the CGST Act, with a matching penalty under the SGST Act, so the practical exposure is up to Rs.50,000 per contravention. Officers invoke it for procedural lapses such as not displaying the registration certificate, minor documentation errors during transit, or failure to furnish information called for. Because the amount is discretionary, a reasoned reply showing the breach was technical and without revenue loss often brings the figure down substantially.
How do I check whether any GST notices have been issued to my business?
Log in to gst.gov.in and go to Services, then User Services, then View Notices and Orders for registration-related communications. Crucially, adjudication notices such as ASMT-10, DRC-01A and DRC-01 appear under a separate tab called View Additional Notices and Orders, which many taxpayers never open. Also verify that the email and mobile number on your registration are current, since the portal sends alerts there. What happened to the old 12 percent and 28 percent GST slabs?
Both slabs were abolished with effect from 22 September 2025. Nearly all goods that were at 12 percent moved down to 5 percent, and the bulk of the 28 percent items moved to 18 percent, with only a small set of luxury and demerit goods shifted up to the special 40 percent rate. This means old rate charts, printed price lists and software masters created before September 2025 are unreliable. Can one invoice contain items taxed at different GST rates?
Yes, there is no requirement to issue separate invoices per rate. A single tax invoice can carry multiple line items, each with its own HSN code, taxable value, rate and tax amount, and the totals section simply aggregates the tax rate-wise. Printing truncated or wrong codes on invoices creates mismatches later, so set the codes correctly in your billing software once.
What falls under the 18 percent standard rate of GST now?
The 18 percent slab is the standard rate for most services and for goods that are neither essentials nor demerit items. Notably, several products that earlier suffered 28 percent moved down to 18 percent from 22 September 2025: air conditioners, televisions of all sizes, dishwashers, cement, small cars and motorcycles up to 350cc, and most auto parts.
