Implementing the 54th GST Council decisions, CBIC clarified that extruded or expanded savoury or salted products other than un-fried snack pellets fall under tariff item 1905 90 30 and attract twelve per cent prospectively, while un-fried or uncooked snack pellets continue at five per cent. Roof-mounted package unit air conditioning machines for railway coaches were held classifiable under heading 8415 and not as railway parts, and the rate position on motor car seats was settled.
What to do about it: Namkeen and extruded snack manufacturers must apply the clarified rate prospectively and can rely on the circular's regularisation for earlier supplies.
Skill Lotto Solutions (P) Ltd v. Union of India — Supreme Court, 2020 · 2020-12-03
The Supreme Court upheld the levy of GST on lotteries, holding that the inclusion of actionable claims such as lottery, betting and gambling within the definition of 'goods' under Section 2(52) CGST Act is constitutionally valid and not discriminatory. It further held that GST is payable on the face value of lottery tickets, including the prize money component, rejecting the argument that prize money should be excluded from the taxable value.
What to do about it: The ruling confirms Parliament's wide power to tax actionable claims under GST — businesses in gaming, contests and promotional schemes should price for GST on gross face value.
Notification No. 57/2017-Central Tax dated 15.11.2017 · 2017-11-15
This notification allowed registered persons with an aggregate turnover of up to Rs 1.5 crore in the preceding or current financial year to furnish the statement of outward supplies in FORM GSTR-1 on a quarterly rather than monthly basis, and prescribed the quarterly due dates. It was the first structural concession recognising that monthly outward supply reporting was disproportionate for very small businesses.
Why this matters: This quarterly GSTR-1 concession is the direct ancestor of today's QRMP scheme, and many small Chennai businesses have been on a quarterly cycle continuously since this notification.
