GSTN Advisory dated 23 August 2024 — introduction of the RCM Liability/ITC Statement · 2024-08-23

GSTN introduced a new RCM Liability and ITC Statement on the portal so that reverse charge tax declared in Table 3.1(d) of GSTR-3B can be matched against the corresponding credit claimed in Table 4A(2) and 4A(3). It applies from the August 2024 tax period for monthly filers and from the July to September 2024 quarter for taxpayers under the quarterly scheme. Taxpayers were required to report an opening balance of reverse charge liability paid but credit not yet claimed, or credit claimed without payment, within the window announced by GSTN.

Why this matters: Reconcile reverse charge payments with the credit taken every month, since the department can now see an RCM ledger for your GSTIN.

Agricultural seedling trays are plastic articles taxable at 18 percent

Saro Enterprises - AAR Tamil Nadu (2018), upheld by AAAR Tamil Nadu, order dated 6 February 2019 · 2018

The applicant made polypropylene and recycled plastic trays used by farmers to raise paddy and vegetable seedlings, and argued that they were agricultural implements. The Authority held that the trays are other articles of plastic under heading 3926 90 99 and are taxable at 9 percent central tax and 9 percent State tax. Use in agriculture does not by itself bring a product within the exempt agricultural implements entry, and the material and the tariff description prevail over the end use.

What it means for you: Chennai suppliers to the farm sector cannot assume exemption merely because the buyer uses the product in agriculture.

Snack pellets, fish soluble paste and imitation zari clarified at 5 per cent

Circular No. 200/12/2023-GST, dated 1 August 2023 · 2023-08-01

Giving effect to the 50th GST Council decisions, CBIC clarified that un-fried and uncooked snack pellets manufactured by extrusion are classifiable under tariff item 1905 90 30 and attract five per cent with effect from 27 July 2023, and that fish soluble paste moved from eighteen to five per cent from the same date. Imitation zari thread or yarn made from metallised polyester or plastic film was placed at five per cent, and past periods were regularised on an as-is basis.

What is a B2C large invoice and what is the current threshold?
A B2C large invoice is an inter-state supply to an unregistered person exceeding the notified value threshold, which was reduced from Rs.2.5 lakh to Rs.1 lakh. My credit notes this month exceed my sales. Can GSTR-3B show a negative figure?
Yes. Since the January 2024 tax period, the portal permits negative values in Table 3.1 of GSTR-3B where credit notes issued in a month exceed the outward supplies, a situation common in businesses with heavy sales returns. The resulting negative liability is carried forward automatically by the system and adjusted against the liability of subsequent tax periods, so you no longer need to defer reporting credit notes. Ensure the same credit notes are reported in GSTR-1, because GSTR-3B auto-populates from it and manual deviations invite the portal's variance flags. Retailers with seasonal return spikes benefit most from this facility.
How does a GTA opt for forward charge, and by when must it be done?
The option is exercised by filing the Annexure V declaration on the GST portal. For an existing GTA, the window for a financial year runs from 1 January to 31 March of the preceding financial year, so the choice for the coming year must be locked in by 31 March. A newly registered GTA must file the declaration within forty-five days of applying for registration or one month from the date of obtaining registration, whichever is later. Once exercised, the option continues for future years automatically unless the GTA files Annexure VI to revert to reverse charge. Missing the window means remaining under the default reverse charge mechanism for the whole year.
My company has taken a residential flat on rent. Why is our accountant paying GST on it?
Because of a reverse charge entry effective 18 July 2022: renting of a residential dwelling to a registered person attracts 18 percent GST payable by the tenant under reverse charge, even when the landlord is unregistered. Renting to unregistered individuals for residence remains fully exempt. There is a carve-out from 1 January 2023: a proprietor renting a dwelling in his personal capacity for use as his own residence, on his own account and not for the business, is exempt. Companies and firms renting flats, including for guest houses, must therefore pay RCM monthly through GSTR-3B. We correct many such missed entries during our compliance health checks.
My shop was closed for a month. Can I skip filing GST returns for that period?
No. Once you hold an active GSTIN, returns must be filed for every tax period regardless of business activity. If there were no sales and no purchases, you must file nil GSTR-1 and nil GSTR-3B for that month. Skipping creates a break in the sequential filing chain, blocks future returns, accumulates late fees and can eventually lead to suspension of registration. Nil returns take only minutes and can even be filed by SMS. If your business in Manali has periods of inactivity, ask us about our low-cost nil filing plan.
I claimed some ITC wrongly last year. What interest and penalty apply if I reverse it now?
Under Section 50(3) as amended, interest at 18 percent per annum applies where wrongly availed credit has also been utilised, calculated from the date of utilisation until reversal; credit that was availed but never utilised, because your ledger balance never fell below the wrong amount, attracts no interest. Voluntary reversal is done through GSTR-3B or by payment in DRC-03, and paying before any show cause notice generally avoids or minimises penalty. My supplier has not uploaded an invoice and it is missing from GSTR-2B. Can I still claim the ITC?
No, not until it appears. Since 1 January 2022, Section 16(2)(aa) permits ITC only on invoices furnished by the supplier in GSTR-1 and communicated to you in GSTR-2B; the earlier provisional credit tolerance is gone. Claiming credit on a missing invoice invites a Rule 88D intimation and reversal with interest at 18 percent. The practical remedy is vendor follow-up: withhold the tax portion of payment until the supplier uploads, and claim the credit in the month it appears in GSTR-2B, subject to the overall time limit of 30 November following the financial year. Vendor discipline clauses in purchase orders help enormously.
I received an intimation in DRC-01C about ITC mismatch. How do I respond?
DRC-01C is issued under Rule 88D when the ITC claimed in your GSTR-3B exceeds the ITC available in GSTR-2B beyond the permitted limits. You must respond within seven days, either by paying the excess with interest through DRC-03 or by explaining the difference in Part B of DRC-01C, citing valid reasons such as credits of earlier periods claimed within time, reclaims after Rule 37 payment, or import ITC not flowing through 2B. Until you respond, the portal can block filing of your next GSTR-1. Do not ignore the seven-day window; call +91 - 9600 606 444 the day it arrives.
Which goods and services attract the new 40 percent GST rate?
The 40 percent rate is confined to luxury and demerit supplies. It covers aerated waters, caffeinated and other sugary carbonated beverages, large cars beyond the small-car specifications, motorcycles above 350cc, yachts, personal aircraft, and specified actionable claims such as betting, casinos and online money gaming. Pan masala and tobacco products continue under their earlier levy structure until the compensation cess obligations are discharged, after which they move to the 40 percent rate as notified. If your business deals in any of these lines, pricing and working capital need careful planning.
Where is the place of supply for services connected to a building or land?
Services directly relating to immovable property, including those of architects, interior decorators, engineers, surveyors, construction and works contract services, renting, and accommodation in hotels, are supplied where the property is located, under Section 12(3). The recipient's location and registration are irrelevant. So a Manali architect designing a factory in Coimbatore charges CGST plus SGST of Tamil Nadu, but for a project in Kochi the place of supply is Kerala and IGST applies. For hotels, the state where the hotel stands is always the place of supply, which is why accommodation is invariably billed with that state's local taxes regardless of where the guest's business is registered.
Which food items became completely tax-free under GST 2.0?
From 22 September 2025, UHT milk, pre-packaged and labelled paneer and chena, and all Indian breads including roti, chapati, paratha and khakhra attract nil GST. In the pharma space, thirty-three notified lifesaving drugs and medicines for cancer and rare diseases also moved to nil rate. Remember that selling nil-rated goods still has compliance effects: you issue a bill of supply instead of a tax invoice for such items, and input tax credit attributable to nil-rated supplies must be reversed proportionately under Rules 42 and 43. Grocery retailers in Manali commonly need help splitting mixed billing correctly.
What is the GST treatment for an event management company handling corporate events?
Event management services attract 18 percent with full input tax credit. Place of supply rules deserve attention: for organising an event for a registered client, the place of supply is the client's location, so a Chennai company organising a Goa offsite for a Bengaluru-registered client charges IGST to Karnataka. For unregistered clients, the place of supply is where the event is actually held. Admission tickets are taxed where the event takes place. Getting the state wrong means the client's credit is jeopardised and the tax may need repayment under the correct head, so event companies serving multi-state clients should map each contract before invoicing.
Is a pure labour contract for building a house exempt from GST?
Two exemptions exist for pure labour contracts, meaning contracts where the contractor supplies only labour and the owner buys all materials. First, construction, erection or installation of original works pertaining to a single residential unit, otherwise than as part of a residential complex, is exempt. Second, pure labour services under the Pradhan Mantri Awas Yojana for beneficiary-led individual house construction are exempt. Outside these, labour contracts are taxable at 18 percent. A mason team building one independent house in Manali on labour-only terms therefore charges no GST, but the same team working on an apartment project must.
I returned an advance because the deal was cancelled. What document do I issue?
It depends on how far the paperwork went. If you had issued only a receipt voucher and no tax invoice, you issue a refund voucher under Rule 51 when returning the advance, and the tax paid on that advance can be adjusted. If a tax invoice had already been issued, the cancellation is handled through a credit note under Section 34 instead. The refund voucher records the original receipt voucher reference, the amount refunded and the tax involved. Event managers and contractors see cancellations regularly, and using the wrong document between these two is a common reconciliation error.
Should I claim a refund of my accumulated ITC or just carry it forward?
Carry-forward suits businesses whose future output tax will absorb the credit within a few months, since it avoids refund paperwork. A refund makes sense when the credit keeps growing and will never be absorbed, which is typical for exporters under LUT and businesses with inverted duty structure, because idle credit is interest-free money locked with the government. Remember that refunds are only available in categories permitted by Section 54; ordinary accumulated credit from slow sales cannot be refunded. A quick review of your credit ledger trend over six months usually makes the right answer obvious.
