Electrical wiring harness classified as insulated wire, not a vehicle part

WABCO India Ltd - AAR Tamil Nadu, Order No. TN/10/AAR/2018, dated 27 September 2018 · 2018-09-27

The manufacturer supplied electrical wiring harness, essentially electrical wire with connectors at both ends, used in motor vehicles, and asked whether it should be classified as a motor vehicle part or as insulated electrical conductors. The Authority classified the product under heading 8544, which covers insulated wire and cable fitted with connectors, taxable at 9 percent central tax and 9 percent State tax following Notification No. 41/2017-Central Tax (Rate) dated 14 November 2017, the earlier rate having been higher.

Practical effect: Chennai auto component makers should classify by the tariff description of the article itself, not by the vehicle it eventually goes into.

Circular

Director's personal property rent outside reverse charge; cinema food taxed as restaurant service

Circular No. 201/13/2023-GST · 2023-08-01

CBIC clarified that where a director rents out immovable property to the company in his personal capacity rather than as a director, the reverse charge entry for director's services does not apply and the ordinary forward charge rules govern. It also clarified that supply of food and beverages in cinema halls is taxable as a restaurant service at five per cent without input tax credit, unless the sale of the ticket and the food are clubbed as a composite supply with the ticket as the principal supply.

Why this matters: Companies paying rent to a director for personally owned premises need not discharge reverse charge under the director's-services entry, but must check the landlord's registration status.

Staggered GSTR-3B due dates of 20th, 22nd and 24th introduced

Notification No. 07/2020-Central Tax · 2020-02-03

CBIC replaced the single 20th-of-the-month GSTR-3B deadline with a staggered system. Taxpayers with aggregate turnover of Rs 5 crore or more in the previous financial year continued to file by the 20th. Smaller taxpayers were split by State: those in Tamil Nadu and the other southern and western States were given the 22nd, while the northern and eastern States were given the 24th. The arrangement was first notified for the January to March 2020 returns.

What to do about it: A Chennai business below Rs 5 crore turnover files GSTR-3B by the 22nd, not the 20th, and late-fee notices computed from the 20th should be contested.

My company has taken a residential flat on rent. Why is our accountant paying GST on it?
Because of a reverse charge entry effective 18 July 2022: renting of a residential dwelling to a registered person attracts 18 percent GST payable by the tenant under reverse charge, even when the landlord is unregistered. Renting to unregistered individuals for residence remains fully exempt. There is a carve-out from 1 January 2023: a proprietor renting a dwelling in his personal capacity for use as his own residence, on his own account and not for the business, is exempt. Companies and firms renting flats, including for guest houses, must therefore pay RCM monthly through GSTR-3B. We correct many such missed entries during our compliance health checks.
How does an ISD actually distribute credit among branches?
Distribution follows Section 20 read with Rule 39. Credit attributable to a single branch goes only to that branch; credit for common services is distributed among operational branches in the ratio of their turnover in the preceding financial year. The ISD issues an ISD invoice to each recipient GSTIN and reports the distribution in GSTR-6 by the 13th of the following month, after which the credit appears in each branch's GSTR-2B. IGST credit is distributed as IGST, while CGST and SGST credit is distributed as IGST to branches in other states. Excess distribution is recoverable from the recipient with interest, so the turnover ratios must be computed carefully each year.
I made a mistake in GSTR-3B. Can I revise it?
No, GSTR-3B cannot be revised once filed. The GST law allows corrections only through adjustments in the returns of subsequent tax periods. If you under-reported tax, pay the difference with 18 percent interest in the next GSTR-3B or through Form DRC-03. If you over-reported, adjust it in a later month within the time limits allowed. Errors in GSTR-1 can be amended in the following period's return. Because corrections have deadlines, it is best to have the error reviewed quickly; our team in Manali can assess it the same day.
Do I have to report HSN codes in my GSTR-1?
Yes. Taxpayers with aggregate turnover up to Rs.5 crore must report a 4-digit HSN summary for B2B supplies in Table 12 of GSTR-1, while those above Rs.5 crore must report 6-digit HSN codes for all supplies. A single price for naturally bundled components is a composite supply, taxed at the rate of the principal supply. Printing separate invoices for books at nil rate out of a bundled fee is a known audit red flag and is routinely rejected. If the institute genuinely sells optional printed books to anyone at a separate price, those standalone sales can take the book's own treatment. Structure the fee schedule deliberately, not after the demand arrives.
Can my company claim ITC on GST paid to a contractor building our new office?
Generally no. Section 17(5) blocks input tax credit on works contract services and on goods or services used for construction of immovable property on your own account, even when the building is used for business. The exception is plant and machinery, so credit on GST paid for installing machinery, equipment or apparatus fixed to earth remains available. The block does not apply within the construction chain itself: a sub-contractor's works contract service supplied to the main contractor is creditable for the main contractor, since it is used for an onward works contract supply. Classifying civil costs correctly during a project saves disputes at audit.
My supplier has not uploaded an invoice and it is missing from GSTR-2B. Can I still claim the ITC?
No, not until it appears. Since 1 January 2022, Section 16(2)(aa) permits ITC only on invoices furnished by the supplier in GSTR-1 and communicated to you in GSTR-2B; the earlier provisional credit tolerance is gone. Claiming credit on a missing invoice invites a Rule 88D intimation and reversal with interest at 18 percent. The practical remedy is vendor follow-up: withhold the tax portion of payment until the supplier uploads, and claim the credit in the month it appears in GSTR-2B, subject to the overall time limit of 30 November following the financial year. Vendor discipline clauses in purchase orders help enormously.
Why is my nil return SMS to 14409 not working?
SMS filing fails for a few common reasons. The message must come from the exact mobile number registered against an authorised signatory on the GST portal, the format must match precisely with single spaces, and all returns for earlier periods must already be filed since GST returns are sequential. It also fails if the return is not truly nil, for instance if an amendment or credit note is pending to be reported. If one number is registered for multiple GSTINs, each needs its own SMS. Who has to file the GSTR-9 annual return?
GSTR-9 is the annual return for regular taxpayers, consolidating the outward supplies, input tax credit and tax paid reported through the year's GSTR-1 and GSTR-3B filings. As per CBIC notifications, filing is optional for taxpayers with aggregate turnover up to Rs.2 crore for the relevant financial year, and mandatory above that. Composition taxpayers file GSTR-4 instead, and e-commerce operators collecting TCS under Section 52 file GSTR-9B. How do I file Form PMT-09 to move money between heads in my cash ledger?
Log in and open Services, then Ledgers, then Electronic Cash Ledger, and select File GST PMT-09 for transfer of amount. The screen shows your balance under each major and minor head. Choose the transfer-from head and amount, choose the transfer-to head, add the details to the table, preview and file with DSC or EVC. The transfer reflects in the ledger immediately and an ARN is generated for your records. There is no limit on how often PMT-09 can be filed, and no government fee applies, so it is always the first fix for a wrong-head deposit.
Is the late fee charged on delayed returns the same thing as a penalty?
No, they are legally distinct. Late fee under Section 47 is an automatic, fixed daily charge for filing a return after its due date, computed by the portal and payable in cash before the return is accepted; no officer discretion or notice is involved. Penalty, under provisions such as Sections 122 to 125, is imposed through adjudication for specified offences, requires a show cause notice and hearing, and can be contested or reduced. Interest under Section 50 is a third, separate levy compensating for delayed payment. A delayed return with tax due can therefore attract all three simultaneously, each on its own footing.
What is the difference between the electronic cash ledger and the electronic credit ledger?
The electronic cash ledger reflects actual money you have deposited through challans, plus TDS and TCS credits you have accepted; it can pay tax, interest, penalty, late fee and any other amount. The electronic credit ledger reflects input tax credit claimed through your returns, and it can be used only for paying output tax, never for interest, penalty or late fee. Both are visible under Services, then Ledgers, after login. Refund of an excess cash balance is possible, while credit is refundable only in specified cases such as exports and inverted duty structure.
What is the electronic liability register on the GST portal and why should I check it?
The electronic liability register, maintained in Form PMT-01, records every liability raised against your GSTIN: self-assessed tax from returns in Part I, and demands from assessments, adjudication orders and DRC-07 summaries in Part II. Payments and pre-deposits are set off against these entries. You can view it under Services, then Ledgers. Checking Part II periodically matters because demand entries you never noticed can trigger recovery, interest accumulation and refund adjustments. Our company paid fees to a lawyer. Who pays the GST on this?
You do, as the recipient. Legal services supplied by an individual advocate, a firm of advocates or a senior advocate to a business entity are notified under Section 9(3), so the advocate does not charge GST and your business pays 18 percent under reverse charge in cash through GSTR-3B, claiming it back as ITC if otherwise eligible. Relief exists for small recipients: legal services to a business entity whose turnover is within the registration threshold are exempt. Which daily-use grocery items became cheaper under GST from September 2025?
