Notification No. 03/2022-Central Tax (Rate) dated 13.07.2022 · 2022-07-13
Giving effect to the 47th GST Council's rate rationalisation, this notification raised the rate on works contract services supplied to the Central Government, State Government, Union territory and local authorities from 12 per cent to 18 per cent with input tax credit, applying from 18 July 2022. Several High Courts, including the Madras High Court, have since heard petitions by contractors seeking reimbursement of the differential tax from the awarding department on contracts priced before the change.
Practical effect: Chennai civil contractors with pre-July 2022 government tenders should pursue a differential-tax claim with the department rather than absorbing the 6 per cent increase.

Tamarind seeds, copra as distinct from edible coconut, pure mehendi paste without additives, scented and flavoured sweet supari, brewers' spent grain and distillers' grains were each assigned a rate, and the position on renewable energy project valuation was restated.
Practical effect: Provision stores and dry-fruit traders in Chennai should re-check whether their stock is fresh or dried, because that single fact decides between nil and a taxable rate.
Munjaal Manishbhai Bhatt v. Union of India — Gujarat High Court, 2022 · 2022-05-06
In a bungalow purchase where land constituted the dominant value, the Gujarat High Court held that the deeming fiction treating land value as one-third of the total consideration for GST on construction is arbitrary if applied mandatorily. Where the actual value of land is ascertainable from the agreement, tax must be computed after deducting the real land value; the one-third deduction in the rate notification was read down as optional, available at the taxpayer's choice.
Practical effect: Builders and buyers with separately valued land agreements can compute GST on actual construction value — worth revisiting for plotted developments and villa projects around Chennai.
